A Father’s Right to Parent His Child and Constitutional Law That Says So

Fathers walk into family courts – generally hauled in under a wife’s complaint for divorce – and can’t believe the injustice they face. These courts deny them their children and other rights at the whim of the judge.

The fathers’ reaction is justified because we all have an innate understanding of what’s right and what’s wrong. And we all understand that we have fundamental rights that governments should uphold. This article gives proof of their parental rights and evidence of family court corruption.

The rights we expect are ‘unalienable rights’. It was these rights that the U.S. was formed to secure according to America’s Declaration of Independence: “the unalienable right to life, liberty and the pursuit of happiness”.

Included in such rights are your property and your parental rights as explained in the U.S. Constitution’s Bill of Rights and further amendments and U.S Supreme Court case law. Most important among those rights is the protection of those rights against unjust denials of them by government or anyone else.

To protect those rights, our judicial system is supposed to require a fair process before any fundamental right is denied or even limited. The Supreme Court long ago settled the detailed and fair legal process required – or ‘due’ – when fundamental right of a litigant is at stake. It’s the ‘due process clause’ and maps out the substantive due process necessary. But never is a right to be denied or limited unless a substantial wrong has been proven with clear and convincing evidence against the person to be denied.

It’s in court where the rubber meets the road; i.e. it’s through the legal process that you find out what rights you really have as opposed to what you think you have – or should have. Fathers are finding out that they’re being denied constitutional protection of their fundamental rights.

1. Your parental rights and other rights a father has:

Your right to life, liberty and happiness may seem somewhat vague, but the founding fathers and later Supreme Court case law has tried to enumerate what fundamental (i.e. unalienable) rights it implies. The right to property and your possessions was one and the right to a trial by jury was considered an essential right to help protect you from unjust laws, judicial processes, and judicial corruption.

Beyond those, you have the right to parent your children. That means you have the right to the care, custody, maintenance, and companionship of your child(ren) since this is recognized as one of the most fulfilling aspects to a purposeful and satisfying life. Since your children are your most precious possession, the state can only alter a parental right of he’s ‘unfit’ – and proven so by clear and convincing evidence.

In the 1978 case of Quillon v Walcott, the Supreme Court ruled: “If a state were to attempt to force the breakup of a natural family, over the objection of the parents and their children, without some showing of unfitness and for the sole reason that to do so was thought to be in the children’s best interest,” the Due Process Clause would clearly be violated.

Further, in Parham v. J.R. et al 442 U.S. 584 (1979), the Supreme Court declared the ‘best interest of the child’ resides in the fit parent – not in the state: “Our constitutional system long ago rejected any notion that a child is a “the mere creature of the State”.

In 2000, the United States Supreme Court ruled in Troxel v. Granville 530 U.S. 2000: “{S}o long as a parent adequately cares for his or her children (i.e. is fit), there will normally be no reason for the State to inject itself into the private realm of the family to further question the ability of that parent to make the best decisions concerning the rearing of that parent’s children.”

So, according to this Supreme Court case law, if you’re not proven unfit, then the state cannot interfere with your right to parent your child. The best interest of the child resides in you – as fit parent. In fact the ‘best interest of the child’ can only be used where there is not fit parent present.

The ‘equal protection clause’ of the 14th Amendment, requires that one fit parent must necessarily retain all of his fundamental rights to the extent that the other does. The minimum limitation of these rights must be 50% of time with each child. Doing otherwise would not only deny the fundamental right of parenting but abridging the equal protection clause too.

2. Other fundamental rights you have include:

* the right to follow any choice of lawful occupation without the state’s interference.

* the right to not have your private lives invaded by the state if you have not committed a crime.

* Not being jailed for not paying a debt incurred by you through your agreement, nor imposed on you by a state – if you can’t pay it.

* Not being jailed or restricted in where you can go without justifiable cause. 3. Injustice in the courts today

The founding fathers recognized that the weakest link in the preservation our unalienable rights was the judiciary. Its corruptibility would easily undermine the rights of persons or groups of persons while hiding behind its singular authority and only option for a person seeking justice under unjust accusations and claims.

‘Fathers rights groups’ recognize that our courts are now corrupted. No longer are their rights protected. Now is the time to join the revolution to bring back liberty and justice for all.

Homeland Security Jobs in the US ? Booming Job Market

In the wake of 9/11 the homeland security business is still booming, and now it eclipses mature enterprises like movie-making and the music industry in annual revenue. In this multi-billion business airport security was the initial focus, but during the past years the industry has expanded into a wide range of companies hawking all kinds of products and services for securing nearly every imaginable terrorist target. The homeland security industry now includes border, rail, seaport, industrial and nuclear plant protection as well as chemical, biological and radiological detection. One of the biggest customer in the field is a post-9/11 creation, the U.S. Department of Homeland Security. This is a federal agency whose primary mission is to help prevent, protect against, and respond to acts of terrorism on United States soil. Apart from the “traditional” duties, the U.S. Department of Homeland Security received in April this year authority from the congress to waive all legal requirements necessary to expeditiously install additional physical barriers and roads at the border to deter illegal activity. According to Secretary Chertoff: “Criminal activity at the border does not stop for endless debate or protracted litigation,” “Congress and the American public have been adamant that they want and expect border security. We’re serious about delivering it, and these waivers will enable important security projects to keep moving forward.” This extention of activities will again boost the job market and if you are interested in working in this field you should consider to jump on the train. Climate change is an other challenge that will requiere more investments in the homeland security field in the future. According to an article published by Joshua W. Busby of the University of Texas at Austin in the Washington Post on March 22, 2008, the US government needs to take action on risk reduction and adaptation, mitigation of greenhouse gas emissions, and institutional changes in the U.S. government to prepare the U.S. to deal with the threat posed by global climatic disruption.

“Climate and security concerns do not get the attention they deserve in the U.S. government because they have few high-level champions. A new deputy undersecretary of defense position for environmental security should be created to redress the insufficient institutionalization of climate and environmental concerns in the Department of Defense. That said, we should not confuse national defense with what the military can do. As the risk reduction agenda makes clear, other instruments of national power will also be needed. To that end, the U.S. needs several senior positions in the National Security Council dedicated to environmental security, including a Deputy National Security Advisor for Sustainable Development to guide the inter-agency process. The links between climate and security still might not get sufficient attention. A special advisor to the president on climate change with some budgetary authority might also help.”

As a conclusion, homeland security is a booming market for job seekers and the trend will continue for at least five to ten years more. One major terrorist attack in the United States, Europe or Japan could increase the global market in 2015 to 0 billion, more than a twelvefold increase from today’s level, according to Tomer Amit, vice president of Homeland Security Research. “Most of the growth this decade will come from building what Homeland Security Research calls “a homeland defense infrastructure.” Growth areas are likely to include technology for surveillance and for detection of nuclear and other weapons of mass destruction”, Amit says.

All indicators are showing green light for starting a career in this promising and highly interesting industry.

The swell of patriotism that rolled across America after the attacks of 9-11 caused many lawmakers to take another look at American students’ declining report card in American history and civics. America’s students have scored poorly on civics tests and many know little about the basic freedoms on which America was founded.

As a result of this disturbing trend, state lawmakers in Florida and Arkansas followed Texas’ lead and in 2002 and 2003, initiated special curriculum programs in K-12 grades called Celebrate Freedom Week. According to the statutes, one week during each school year students will receive special instruction on America’s founding freedoms and founding documents like the Declaration of Independence.

“Declare IT!” (http://www.declareitprogram.com) is a new, privately sponsored program that supports Celebrate Freedom Week in Florida, Arkansas and Texas, offers additional program awareness and provides free teaching resources to teachers and parents.

Founded by Jack Boyd of Alpharetta, GA, the program offers a free, fun sing-along song and teaching resources with online links to lesson plans for Celebrate Freedom Week. Boyd founded the program after his two children did a high school history project on Celebrate Freedom Week in Florida. Boyd discovered that Floridians’ knowledge of the program was low and teacher participation was inconsistent.

“America’s students need a solid understanding of America’s history to become the leaders America needs in the future. Celebrate Freedom Week is a great step toward that goal. However, the program is not getting the focus it needs in many areas and teachers need our help. It’s appropriate on this 5-yr anniversary of 9-11, when we pause to remember the lives lost in that tragic event, that America’s teachers, leaders and parents recommit ourselves to teaching our children about the freedoms that were also attacked that day,” said Mr. Boyd.

In 1998, Jack Boyd and daughter Steffy wrote ‘The Declaration of Independence Song,’ a sing-along song to help Steffy learn the words to the Declaration for a 4th grade homework project. Offered on a CD to teachers and parents in 2002 through their website (http://www.declarationsong.com), the song has become very popular with teachers, home school parents and others across the country. Freedom Dilemma in the Arab States

 Since man existed on earth, freedom for him is two types in definition, one is freedom of, and the other is freedom from. While in theory they both may mean related to each other, in reality they are far from each other according to cultural norms and mores.  Freedom of is the absence of constraints on behavior, it means freedom to do something. In modern time, the two types are defined logically as related to each other in any political system.  In this sense, freedom is synonymous with liberty in two important areas, freedom of worship, (religion in general),  and freedom of speech. The freedom from, however, includes two types of freedom. Freedom from fear, and freedom from want.  In both areas, immunity from fear and want against oppression and exploitation and immunity from discrimination and racism, and both are equated with equality and justice.

The influence of the concept order, however, makes the difference in practice, for example, under authoritarian political systems freedom of is largely forgotten, through legislation or executive branches of governments. This means, that freedom from, fear and want is also persistent. I believe that freedom of is more applicable than freedom from in both authoritarian and liberal political systems, at least, theoretically. They are nonetheless, differ greatly, in application.

Order, whither, social or political, refer to established patterns of authority in society. Where traditional modes of behavior are followed. It is the norms of doing things. Such norms prescribe behavior in different areas, such as school systems and students’ behavior in schools, by appearance and obedience.  Marriage behavior according to law (religious or secular), and press publication and explicit photography (without anarchy).

 In modern time, states are different in applying freedom of, or freedom from according to their political systems. While in advanced countries we may observe justice, and liberty in both types of freedom, justice and liberty are rarely noticed in totalitarian or traditional systems like the Arab countries for example. In most of the Arab states, liberty is limited and justice is exploited by those who have ( power, or wealth) over those who have not (non-citizens-workers, and service people, the less educated). While we use here two important concepts in Marx’s theory of capitalism, we do not mean, that they mean the same thing after more than a century ago. The means of production and property ownership is taking new shapes under the concept of order, especially, the political one.

In the Arab countries, where lack of laws application from traditional personalities undermines liberty and justice, where both became culturally accepted without resistance. If not, they will be exploited by security measures of order.

Terrorism as we knew in recent years have played a vital role in making deviation from all types of freedom, Religious, free speech, fear and want, where corruption of traditional regimes, helps out the idea of keeping the state order by ignoring freedom of and freedom from. So we see that product prices has no limits, and bread becomes more and more less in health value and  more in price.

In strategic planning, or in the transitional periods from one old political system to another more open to all types of freedom, Arab states are urged to apply both types of freedom, at least freedom of worship and liberty, because these two can be applied away from discrimination and exploitation by following the rules of law, which is absent in most Arab countries. Rules of law, however, do not mean, traffic laws, or marriage laws, but laws of justice and equality of citizens and non citizens alike, live inside their borders. Rules of law of limited presidency ( where presidency periods go up to four plus times or life, in Algeria, Egypt, and Tunisia, for example)   

I believe, if this happened, and rules of law become understood, in theory and application, we, then, would say, that the Arab countries are in the right track of healthy governments. While symptoms of this vision is showing in some areas, traditional application of rules of law are missed from government departments, especially the ones connected to cultural norms built up through centuries of wrong beliefs and heretics of rulers, theologians and sheep-like conformity, citizens. Many people such as temporary contract agency employees, construction contractors, service contract workers such as custodians and maintenance personnel were and are directly affected by this heightened process.

This article provides a quick overview of the formal processes used by most federal government agencies to obtain security clearances for the many and varied jobs within the government. The General Services Administration (GSA) will serve as the ‘typical’ agency because GSA encompasses nearly all variations on the theme of security clearance, using such as they do, contract GSA employees both full time and part time; construction contractors; service contractors; information technology contractors; security contractors; and, many other kinds of personnel found at most agencies with the typical kinds of clearance. You could just as easily insert the VA or the BOP and this article would equally apply.

Secret, Top Secret and higher clearance levels will not be discussed here, as those clearances are reserved for unique situations usually related to high levels of national security.

In the immediate aftermath of 9/11, the federal government began reorganizing and restructuring processes and procedures relating to the kinds of security clearances required by the feds. For purposes of this discussion, we’ll talk about clearances at lowest technical level of “confidential”, defined as:

Material, which, if improperly disclosed, could be reasonably expected to cause some measurable damage to the national security. The vast majority of civilian contractor personnel are given this very basic level of clearance.

For the typical federal applicant, either as a contract agency employee or contractor/subcontractor employee, the Department of Homeland Security Federal Protective Service, is the administrator of the security clearance process. DHS/FPS as it is known, issues the SF-85P, Questionnaire for Public Trust Positions form, and administers the Electronic Questionnaire for Investigations Processing (e-QIP) clearance system. The DHS/FPS office of Contract Suitability Adjudication (CSA) Section conducts the background investigation and issues the determination for suitability clearance.

There are five suitability determinations:

1. Full Time – Greater than six (6) months or longer and/or routine access – HSPD-12 compliant NACI/NACLC suitability determination.

2. Temporary – six (6) months or less and/or routine access – NAC suitability determination.

3. Construction – After substantial completion (same as Full time or Temporary, above).

4. Lessor – Level 4 and fully occupied Level 3 facilities (same as Full Time or Temporary).

5. Child Care – NAC suitability determination (in accordance with Crime Control Act).

Let’s take # 1, Full Time: There are three acronyms here that need explained. The NACI stands for the National Agency Check with Inquiries; combined with the NACLC, the National Agency Check with Local Agency, this NACI/NACLC grouping means that once the background questionnaire form SF 85P is submitted by an individual, the DHS/FPS will contact the local law enforcement agency having jurisdiction in the area in which you live, to see if you have been in trouble with the local law.

As noted on the SF 85P, the feds don’t care about traffic offenses that resulted in fines of 0 or less. And while it does not specifically say so on this on the form, the feds don’t particularly care about minor misdemeanors, in general. The best policy is to answer all questions on the SF 85P accurately and truthfully.

But face the facts, folks: The Feds are serious, these days. There is a lot of pressure to get it right with a minimum of cost; or at least that’s one of the goals. If your company employs ex-cons or people with law enforcement records, they need to have good paper; meaning the employee should have a paper trail listing their record and the adjudication of the result. In this country, once you have paid for your mistakes, you get a pass and are able to try again. 

If you have just been awarded a federal contract and are applying for a security clearance for the First Time and, your company is applying for say a construction project and you have employees who are currently charged with serious misdemeanors or felonies, or who have been recently convicted of felonies. These people may or may not be cleared to work on federal property. Employees who have drug abuse problems (as in recent arrests for drug possession, dealing, etc) probably won’t be cleared, either. So don’t bother. Your employee will (possibly) not be cleared, your company has lost a lot of time and every one is embarrassed.

These suitability determinations are performed on and affect every person that applies for access to federal properties. As a companion to these determinations, GSA has developed access clearances to kinds and types of specific activity, such as for private sector contractor personnel (construction, service contracts, etc) and for agency employment (contract employees).

Factors considered for both types of personnel are the Position Risk Levels:

Low Risk: Those non-sensitive positions include those positions with potential for impact on duties of limited relations to the agency mission.
Moderate Risk: Those sensitive positions that have the potential for moderate to serious impact on duties very important to the agency mission with significant program responsibilities and delivery of customer services to the public.
High Risk: Those sensitive positions that have the potential for exceptionally serious impact on duties especially critical to the agency mission with broad scope of policy or program authority.

Specific to suitability determination number 3 above, are rules for contractor personnel that must have access to federal property for construction purposes. These are:

Escorted – Temporary Contractors who perform work for no more than 10 business days or require only intermittent (irregular) access are not required to undergo a background investigation provided the contractors are accompanied or “escorted” in accordance with national GSA policy. A contractor that has submitted a complete application with fingerprints and is awaiting a favorable determination may be escorted. Escorts are defined as government employees and Long Term Contract Employees who have received a temporary favorable and possess valid identification credentials.
Short Term – Temporary Contractors who perform work on a daily or routine basis (regularly scheduled) for a period of more than 10 business days but no more than 180 calendar days (6 months) will undergo a law enforcement check and an original SF-85P and two (2) sets of fingerprints on Form FD-258 accompanied by a completed FPS Contractor Suitability Adjudication Worksheet. The SF-85P cannot be completed utilizing the e-QIP process. e-Qip is reserved for long term contract employee use only.
Long Term – HSPD-12 and Office of Management and Budget (OMB) implementing instructions requires all contract employees requiring routine access to federally controlled facilities for greater than six (6) months to receive a background investigation. An SF-85P and two (2) sets of fingerprints on Form 258 are required. If the position sensitivity is determined to be moderate or high risk, a complete GSA for 3665 must be part of the submitted background suitability package. e-QIP is the preferred method of completing the SF 85P requirement and the applicant should follow the instructions provided on the Applicant Information Sheet. All e-QIP Federal Protective Service (FPS) Contractor Suitability Adjudications Worksheets processed through the Service Center Security Clearance Office can be emailed to the regional GSA FPS office. Emailing CIW’s MUST be a WinZip file and encrypted attachment to the email since GSA is transmitting personal identity information (PII) outside of the GSA firewall.

You’ll note that under the ‘long term’ category there is notation of HSPD-12. This is the ‘badge’ every contract employee seeks to have if they desire to work long term on federal property. It’s a “smart” card that has encrypted information about you that, among other things includes the type of clearance issued to you. Security clearances can seem to be a daunting prospect for the uninitiated, but it is not necessarily so. GSA and other agencies have personnel dedicated to assist you in the clearance process, help with ‘bumps in the road’ toward clearance and generally can guide you through the process. It’s another set of paperwork, albeit an important set of paperwork on the path toward federal employment or contractor employment.
