Are Digital Inspections Constitutional?

Whether a search of your computer is legal depends, in large part, on where the search takes place.  If you are singled-out at an international boarder, for example, you are going to be searched regardless of the presence of a “articulable suspicion”.

If you are in a place where you have a reasonable expectation of privacy, on the other hand, the Fourth Amendment to the U.S. Constitution requires probable cause prior to a justified police search of your digital data.

This issue is coming-up with increasing frequency as people travel with their digital lives at their side; and thanks to the increasing sophistication of law enforcement search methods.

Courts have determined that international borders are areas where government interests trump any reasonable expectation of privacy, if one even exists at all.  Customs agents at these boarders are trained to look for smugglers, terrrorists, and child pornographers.

The heightened search and seizure powers of Customs agents were tested in a recent case involving a local contract employee with the Walled Lake Consolidated Schools.  Two years ago, the contractor was intercepted at the US-Canadian border in Buffalo, NY.  Customs agents conducted a digital inspection of his laptop and discovered images of child pornography; some of them made and distributed by the individual.

The former Davisburg resident and Walled Lake schools employee was sentenced last January by a federal judge to 60-years in federal prison.

While no one wants their digital life disturbed when traveling through borders, particularly lawyers with briefcases of confidential goldmines, neither does anyone feel sorry for child pornographers or terrorists.

In another recent case, this one involving a suspected “terrorist”, the former Muslim chaplain at Guantanamo Bay was routinely subjected to digital inspections whenever he re-entered the US.  Once, upon being searched and released, the Muslim chaplin discovered that the Customs agent left a forensic scan disc in his computer.  Although the chaplain was not a terrorist, he fit the profile, so the digital inspections were conducted.

A thorough digital scan of a lap top computer can take more than 3-hours, and that’s without securing a warrant.  Forensic hard-drive copies take even longer to produce.

Digitized information does not always carry signs of illegality like child porn images.  Evidence of terrorism, for example, is often well-hidden and encrypted in the machine’s hard-drive.

The National Association of Criminal Defense Lawyers has taken the position that laptop computer searches conducted at international borders are “non-routine” and thus should require some modicum of articulable suspicion.

Such articulable suspicion is required by highly invasive search modes such as the search of a person’s ailmentary canal.  A laptop search is probably even more intrusive as it encompasses your entire being, both personal and professional.

The UDM Law Review published my article on civil rights claims in the law enforcement seizure context. As a professor of legal studies, I trained paralegals in all aspects of assisting attorneys in private practice, publishing a comprehensive article on this subject in the Mich Bar Journal.

120 year old Bible binding held together with dental floss, rusted metal clasps (120 years as of 2005). This bible was originally used in a Protestant church in Oklahoma, from a private family there. The page style is gothic.

We donated this Bible back to the church in Puerto Vallarta, Mexico. A 92 year old Seattle woman gave it to a friend who gave it immediately to me in West Seattle. She has family but no one is Christian.

As soon as it came into my posession I felt, despite the fine illustrations, unusually fine binding with metal claps and so forth, that it was to be returned to a church on the West Coast. Armed with the Web I went shopping for the right church. Someone paid a lot of money for this bible, and it should have a proper home, restoration, and care. It was too fragile, too fine, and too valuable when restored to be in my collection: I couldn’t keep it, shouldn’t and didn’t.

Searching in Google Image Search over fast internet connection on "Churches + West Coast" when I saw a photo of the Catholic Church in Puerto Vallarta with it’s crown of angels – I knew that was the place. Flying from Seattle to Guadalajara Mexico, I took the large old heavy Bible wrapped up in a clean white sheet in my suitcase. I stayed for a week with friends for my first visit to Mexico – Guadalajara is an old city and very beautiful – people took their time making beautiful architecture from stone.

From there with one of my friends I took a cosy and posh regular night bus from Guadalajara to Puerto Vallarta, Mexico, and rolled it in the suitcase down the long walkway from the oldest hotel in the city Rosita, to the church, several blocks away.

The friend with me was resistant to entering the Catholic Church as she is a different religion however I pursuaded her that I needed her help – which I did as it turned out because I do not speak Spanish. After holding Mass the prime priest’s handler agreed that the lead priest would speak to us about the treasure we wished to donate.

However he just zipped right by us without a glance. So we asked again. The kindest sweetheart of a priest with just the kindest eyes accepted the treasure which he said could be repaired. As a priest, he has seen it all in Puerto Vallarta. He was delighted to have it, and treated it with great respect and reverance. He thanked us profusely as my friend translated.

This shot was photographed on a sheet at our hotel room, laid out on a plastic table, photographed on the deck of the room right next to the sea. With the wind blowing I had to swiftly shoot the images and not many turned out.

The right to freedom of religion is sacred. Freedom of religion means any religion. But you gotta believe in it.

As outrage continued to build on Sunday over President Obama’s support for the mosque and Islamic cultural center slated to be built near the site of the 9/11 World Trade Center attacks, GOP leaders and presidential contenders backed the families who don’t want the complex built on hallowed ground.

On Sunday, Texas Sen. John Cornyn even suggested there could be political fallout over the president’s remarks in the midterm elections.

Obama is "disconnected from mainstream America" and voters this fall will "render their verdict," said Cornyn, who leads the GOP’s Senate campaign committee.

Obama’s support for the mosque was one of the leading topics discussed on the Sunday morning news shows. By early Sunday, nearly all of the major GOP presidential contenders had weighed in on the controversy:

* “Fact president refuses to face is the ground zero mosque is a political statement of radical Islamist triumph over world trade center,” former House Speaker Newt Gingrich tweeted on Saturday. “Over 100 mosques already in New York City… President Obama profoundly wrong in misrepresenting ground zero mosque. There is no issue of religious liberty. He won’t face truth.”
* Former Alaska Gov. Sarah Palin referred her Twitter followers to an article by two liberal Canadian Muslims who called the mosque a deliberate act of provocation. Palin’s tweet: “Mr. President, why are they so set on marking an area w/ mosque steps from what you described, in agreement with many, as "hallowed ground”?
* Minnesota Gov. Tim Pawlenty, though he represents a relatively heavily Muslim state, rebuffed pleas from local Muslim leaders to back off his suggestion that the mosque would "degrade and disrespect" the Trade Center site, Politico reported.
* A spokesman for former Massachusetts Gov. Mitt Romney cited both "the wishes of the families of the deceased and the potential for extremists to use the mosque for global recruiting and propaganda" in opposing it.

Republicans appeared to be on solid political ground in taking a position against the mosque. Nearly every poll on the issue has showed overwhelming opposition to the Islamic center plans, as well as profound doubts about the motives of those behind its funding.

A recent CNN poll showing that 68 percent of Americans oppose the construction of the mosque. A Pew poll found last year that 55 percent of conservative Republicans believe Islam encourages violence.

Moreover, leading Christian and conservative groups that form the base of the Republican Party have also loudly voiced opposition to the ground zero mosque. The Anti-Defamation League, a New York-based Jewish organization with a mission to fight anti-Semitism, said in a July 28 statement that another location should be found.

“In our judgment, building an Islamic Center in the shadow of the World Trade Center will cause some victims more pain — unnecessarily — and that is not right,” the statement, posted on the group’s website, said.

Debra Burlingame, whose brother Charles Burlingame was the pilot of the jetliner that crashed into the Pentagon, said the mosque issue was part of a larger debate about the “clash of civilizations.”

"I do ascribe to the ‘clash of civilizations’ theory now," Burlingame told Politico, referring to a much-discussed theory that Islam in its current state is a natural antagonist to Judeo-Christianity and Western civilization. She also is among the main voices questioning the funding behind the proposed mosque, and the intents of the imam behind it, Feisal Abdul Rauf.

She told Politico that Rauf has made statements supporting radical elements of Islam, and that the location was chosen to be provocative. She also slammed those, mostly led by New York Mayor Michael Bloomberg, who are defending the project under freedom of religion, saying, "That’s a Western concept."

"This is a different model," she told Politico, arguing that in the United States people "for generations had been raised on this concept of separation of church and state, and that you don’t trash someone because of their religion … but that’s not what we’re dealing with here."

"I think the challenge for us is enlisting the Muslims who have already bought into the American program and not adjusting" to Muslim culture, she added. For Burlingame, the issue is not political — she said she objects to the content as well as the form of efforts by Bloomberg and others to push back because the goal is "to shut you up."

The president, meanwhile, seemed to back off from his stronger statements Friday night at a Ramadan dinner at the White House.

During a visit to Florida Saturday, Obama said his support for the right of a Muslim group to build an Islamic center near the World Trade Center site isn’t necessarily an endorsement of the project.

“I was not commenting and I will not comment on the wisdom of making a decision to put a mosque there,” Obama said during a trip with his family to the Gulf of Mexico. “I was commenting very specifically on the right that people have that dates back to our founding. That is what our country is about.”

But on Friday, Obama seemed to offer unabashed support for the mosque as she spoke during an annual White House Iftar dinner, marking the breaking of the daily fast in the Muslim holy month of Ramadan.

“As a citizen, and as president, I believe that Muslims have the same right to practice their religion as everyone else in this country,” Obama said at the dinner. “That includes the right to build a place of worship and a community center on private property in lower Manhattan, in accordance with local laws and ordinances.”

White House deputy press secretary Bill Burton said Obama, in making his comments in Florida, “is not backing off in any way” from his statement at the Iftar dinner.

“It is not his role as president to pass judgment on every local project,” Burton said in an e-mailed statement to Bloomberg Businessweek. “But it is his responsibility to stand up for the constitutional principle of religious freedom and equal treatment for all Americans.”

Politico noted that Republican leaders have largely abandoned former President George W. Bush’s post-9/11 rhetorical embrace of American Muslims and his insistence — always controversial inside the party — that Islam is a religion of peace. The shift fits with traditional Republican attacks on Democratic weakness on security policy.

"Bush went against the grain of his own constituency," said Allen Roth, a political aide to conservative billionaire Ron Lauder and, independently, a key organizer of the fight against the mosque. "This is part of an underlying set of security issues that could play a significant role in the elections this November.

"George Bush made every attempt to reach out," said Rep. Pete King, a leading critic of the mosque project. "The Muslim community did not reciprocate, did not respond. After Sept. 11, some of them became entrenched and really didn’t know how to cope.

"Somehow the leadership in the community does not impel them forward to be more part of the community. That’s my reading of it," said King, who also notes that sensitivities involving the site are far deeper, and more real, than many are willing to recognize beyond the boundaries of New York

What Constitutes Unethical Behavior?

Personal life and business life cannot be perfectly separated with respect to moral judgements. A number of factors have been advanced as significant in making ethical standards a primary concern of business managers.

 

For the individual, the job is the centre of life, and its value must be, in harmony with the rest of life, if he is to be a whole and healthy personality.
In an industrial society. its values tend to become those of the entire corporate culture.
The public is insisting that business leaders are, in fact, responsible for the general social welfare and that the manager’s responsibilities go far beyond those of running the business.
Even if the manager insists on a narrow definition of his role as possible, it is, however, essential that he takes these intangibles into consideration since they are the real motivating force in an organization.
If an organization did not behave in accordance with the social systems and expectations, it may not merely lose its market share but face another piece of legislated control and might also lose its very right to exist.

 

Many times managers may be forced to compromise their personal ethics and moral values in order to achieve organizational goals. Everyday ethical decisions are usually made between the lesser of the two evils rather than obvious right and wrong.

Often it may be difficult for the manager to free himself from taking a biased attitude and look at issues objectively. In spite of good intentions, he becomes involved in the situation and it becomes difficult to retreat and take a detached point of view in examining the issue from an ethical standpoint. In the light of these problems, certain examples can be cited to answer the question as to what constitutes unethical behavior.

 

Padding expense accounts to obtain reimbursement for questionable business expense.
Revealing confidential information of trade secrets.
Giving or accepting gifts or favors.
Using company property and/or materials for personal use.
Leaving the job without abiding by the sales contract.
Being severely critical of competitors.
Attempting to corner opportunities by bribing public officials.
Price discrimination, unfair trade practices, unfair pricing etc. ,
Dishonesty in fulfilling contracts.
Politics inside the organization.

 

Unless and until the professional manager puts the interest of the organisation in front of his own, places the duty to the society above his duty to the organization wholeheartedly, there is no point in talking about ethics in theory. Though a number of firms spend their time, money and energy in formulating statements, in reality their enthusiasm is lost in practice. The gap between the espoused and practiced values create a dissonance in the minds of the people, and as a result in the organization.

On Saturday, October 31, the Founding Church of Scientology of Washington, DC, opened its new premises six blocks from the White House and minutes from Capitol Mall. Attended by nearly 3,000 Scientologists and guests, the Church was dedicated by Mr. David Miscavige, Chairman of the Board of Religious Technology Center and ecclesiastical leader of the Scientology religion.

The building, over 49,000 square feet, represents the Church of Scientology’s largest presence ever in the nation’s capital, a presence that dates back to the 1955 establishment of the Founding Church of Scientology in the District by Scientology Founder L. Ron Hubbard–an occasion considered a milestone in the establishment of Scientology as the only major religion founded in the 20th century, a religion that has since become the fastest-growing religion in the world.

Mr. Miscavige and other speakers gave special praise to the millions of Scientologists world over who have given of their time and effort to make the Church’s anti-drug education initiative the largest non-governmental program of its kind and the Church’s human rights education program the largest on earth. They also praised the work of over 195,000 registered Scientology Volunteer Ministers trained to respond in times of disaster.

In expressing the importance of a prominent Scientology Church in the nation’s capitol Mr. Miscavige stated:

“In a word, this Church is the sum total of all our history and all LRH envisioned when serving as our first Executive Director.

“This is also the kind of Church he envisioned when authoring our programs and campaigns–in anticipation of a day when turmoil knocks out the props and the whole social veneer collapses…”

“Which, of course, is exactly what happened–and thus what prompted our Wake-up Call after 9/11…wherein our history intersects with the history of this nation.”

Yet the significance of a major Church of Scientology in Washington, DC, runs much deeper as Mr. Miscavige made clear:

“You are looking at a living embodiment of the freedom and equality that originally inspired this nation because, yes, this Church stands for life, liberty and the pursuit of happiness. And, yes, it stands here today because of the freedom on which this nation was built–the freedom of religion. For it was here, in this nation’s capital, that we fought for and won our recognition.”

And in the words of Congressman Brad Sherman of California’s 27th District in his address to the gathering:

“I have worked diligently and continuously to express my views, and I believe the views of the entire Congress, that all countries should treat all religions equally and provide true freedom of religion for everyone.”

Congressman Sherman praised the Church’s efforts in raising awareness of the United Nations Universal Declaration of Human Rights, and stated that the battle for human rights includes bringing human rights awareness to all people.

“That is why the efforts of many churches and religious organizations to focus on human rights issues are so important.”

Others speaking and participating in the dedication of the new Scientology Church were Ms. Addie Richburg, President and Chairman of the Board of the National Alliance of Faith and Justice; Ms. Diane Rothe-Smith, Executive Director of the National Voluntary Organizations Active in Disaster (NVOAD); and Mr. Mike Silverstein, President of the Dupont Circle Advisory Neighborhood Association who also represented District of Columbia Mayor Adrian M. Fenty.

Rev. Sylvia Stanard, Director of Public Affairs for the Founding Church, invited all inside to tour the new Church, which includes numerous multimedia presentations in its Public Information Center, describing fundamentals of the Scientology religion, the Church’s worldwide humanitarian and social betterment programs, and the life and legacy of L. Ron Hubbard. As in any Church of Scientology, the doors are always open for people to walk in and find out for themselves.

Washington, DC, played a pivotal role in the life of the Founder of the Scientology religion. At age 13, as America’s youngest Eagle Scout, L. Ron Hubbard traveled cross-country to meet President Calvin Coolidge. As a student at George Washington University in the early 1930s, Mr. Hubbard learned the scientific methodology he later applied to unlocking the riddle of the human mind and life. After World War II, he tested Dianetics techniques on numerous cases at Saint Elizabeth’s Hospital and wrote the first manuscript of his discoveries in Dianetics: The Original Thesis. In 1955, he established the Founding Church and became its Executive Director.

As the people of Iraq wait to read and vote on the newly printed Iraqi Constitution, American educational institutions are looking for ways to commemorate the September 17, 1787 signing of the United States Constitution.

The 2005 school year will mark the first time that all educational institutions receiving federal aid will be required by law to provide programs on the United States Constitution.

National History Day, Inc. has teamed with Newsweek and Oxford University Press to provide teachers with a variety of classroom activities and resources to meet the Constitution Day federal mandate and place our nation’s blueprint in historical context.

“The United States Constitution reflects our nation’s diversity, our unity, and with 27 amendments it stands as a testament to our continued work of forming ‘a more perfect union’,” said National History Day Executive Director, Cathy Gorn. “I believe that the Constitution Day materials we are providing will encourage students and teachers to engage in a dialogue about what it means to be a citizen.”

Sen. Robert Byrd, D-W.Va., introduced the federal legislation requiring education and government institutions to commemorate Constitution Day and President Bush signed the bill into law in December of 2004. When Sen. Byrd introduced the legislation, he stated his hopes that the bill will foster a deeper reverence for and a better understanding of the United States Constitution.

218 years after the 55 delegates to the Constitutional Convention held their final meeting, the United States Constitution stands as the world’s oldest written blueprint for government.
