Unheard-of Freedom to Fellowship

Behold the divine brilliance of God’s new Christ-centered standard. He sent His Son to be the Open Door to previously unheard-of freedom to surrender.

We couldn’t have imagined the astounding riches of grace that God desired for us until He sent His Son to purchase us entirely.

At the point where Christ is Everything to us and there is nothing left of us, then we will have everything we could ever want and we will be everything we could ever want to be. When our whole lives, including our thoughts, and every little and big thing that’s important to us, is consumed by obedience to Christ, then we will become a people who fellowships with the Almighty.

At the point where we are radically dependent on Christ, neither living nor dying nor any other possibility will be terrifying concerns for us anymore. And there will be no room to fear God’s answer or His opinion of us when we are completely dead in Christ.

What’s left to fear when we’re already dead?

Christ also gives us unimaginable freedom as we surrender to Him in the midst of His people. Worldly men might consider themselves strong and independent by their ability to avoid dependence on anyone other than themselves. But, from God’s eternal point of view, this is only small-mindedness. Other men try to make themselves into independent little islands, calling this “self-preservation.” But a better label for this is “addiction to self-centeredness.”

Let this also be encouraging to any Christ-seeker, that seeking Him is a work in progress. We don’t have to be perfect right now to strive toward His otherworldly perfection. And the fact that it takes time to know any mortal person is a hopeful hint, reminding us that getting to know Christ is a gradual development.

If you continue to reserve for yourself a fearful or otherwise fleshly perspective, then you might as well hear the worst of it now, that there is no easy way to fellowship with the living God. There is no shortcut that can skirt His divine timing and there is no factor that removes the necessity for our daily, courageous obedience. Only keep in mind that our job is not to attain to perfection all by ourselves, our job is to allow Him to conform us to His own perfection. As we walk with Him, we will also be enveloped by Him.

As for purity and fullness of life, Christ will not settle for any trace of imitation because He cannot be inconsistent with Himself, the most genuine, real Person in the universe. God sent His Son not so people could have joy from Him and also a variety of lame supplements that we invented on our own. No, but God sent His Son so that His people might have heavenly, unmatchable fullness of joy in Him. The nature of this fullness supersedes and pushes out all non-fullness.

Jesus also said it is heaven just to know the Father and His Son whom He sent. Such a statement is impossible to fake.

Therefore, it is our pleasurable ambition as Christ-seekers to embrace progressively freer freedom in Him, to the point that we live, speak and breathe Him in every situation. On the day our outlooks are dominated by His greatness, we will be a free people indeed.

If we draw near to the living God everyday, then we have a Point of Reference from which we can courageously leap into every life-scenario. There remains no doubt in the saint who knows the greatness of God in Christ. In all these ways Christ is the beginning and end of the answers we seek.

Therefore, be encouraged in Christ, O honest seeker! You needn’t know a lot of things for the Lord to have a devastating foothold on your life. A mere glimpse of Him is enough to send a soul on such an irresistible pursuit of Him that all the opposition in the world cannot discourage that soul.

Neither excess nor lack of any worldly thing should inspire a crippling fear in us because we already have everything in Christ. Indeed, Christ is so great that He not only fulfills all our desires, but He also fulfills God’s desires for the whole world.

All this talk of radical transformation and freedom to fellowship will be most useful to Christ-seekers who are earnest to the point that they will postpone any self-centered goal to let Him make them effective, filled, heavenly vessels of God’s kingdom.

And what more hopeful sign could we ask for than His continual availability to us? The fact that Christ meets us where we are and makes His Presence available proves that He is zealous to make every heavenly goal possible in us who follow and obey Him. Of course, this is all to His credit, and not to ours.

What Constitutes Marital Property In A Rhode Island Divorce Subject To Equitable Distribution?

Rhode Island is an equitable distribution of assets state. R.I.G.L 15-5-16.1 is the statute that pertains to equitable distribution of assets. The Rhode Island Supreme Court has stated on numerous occasions that marriage is an Economic Partnership.

The equitable distribution statute is designed to fairly assign marital property in a Rhode Island Divorce based primarily on the contributions that each party made to the marital estate. Judges in Rhode Island have a lot of discretion to equitably divide marital assets. Equitable does not always mean equal!

The assets capable of being divided obviously include real estate, pensions, retirement accounts, 401k, cars, boats, artwork, collectibles, bank accounts, ira’s, motorcycles, vehicles, time shares, furniture, televisions, computers, and business interests. Retirement benefits are marital assets under Rhode Island Law if acquired during the course of the marriage. Certain disability pensions may not be marital asset.

What steps must a Rhode Island Family Court Judge use to make an equitable distribution in a Rhode Island Divorce?

Equitable division of assets in RI is a multi step process. The first step is for the Judge to determine what property constitutes marital property in Rhode Island. After a judge determines what constitutes marital property, the Rhode Island Family Court judge must apply the factors set forth in 15-16.1. The judge must lastly equitably divide the marital property.

What are the Automatic Court orders and when do they go into effect?

The Husband and wife must be careful not to violate the automatic court orders pertaining to the parties’ assets. This automatic order enters upon the Plaintiff signing the Divorce Petition as to the Plaintiff and becomes effective as to the Defendant in the divorce when the summons is served upon the Defendant. This order essentially prevents either party from unlawfully dissipating assets or canceling life or health insurance among other things.

What property and assets constitute Marital Property subject to equitable distribution in RI?

All property acquired during the course of the Marriage by either party constitutes Marital property subject to equitable distribution with certain exempt property set forth below.

Gifts given by the parties to each other are marital assets which can be equitable divided in a Rhode Island Divorce.

What assets are not marital property under Rhode Island Divorce Law?

Premarital property is not subject to the equitable division statute. Premarital property is property that was acquired by either spouse prior to the date of the marriage.

Income derived from premarital property during the course of the marriage is subject to the equitable distribution statute. The appreciation in value of premarital property during the course of the marriage is also subject to the equitable division statute.

In order for the appreciation of value of premarital property to be equitably divided, the appreciation must result from the efforts of the spouse who do did not own the asset prior to the marriage. This provision requiring that the appreciation result from the efforts of the other spouse is often loosely applied in Rhode Island (RI) Family Court, especially in marriages of long duration.

It is important to note that the Rhode Island (RI) Legislature made a distinction between interest and appreciation in determining whether the other spouse must have expended any effort. The RI legislature did not require any effort of the other spouse in order for interest derived from premarital property to be equitably divided by the Rhode Island Family court in a divorce. It is not required that interest earned from premarital property be derived from the efforts of the other spouse.

Gifts from third parties whether acquired before or during the marriage are not marital property subject to equitable division under Rhode Island Law. The income and appreciation from gifted property is not marital property. This specifically includes life insurance and distributions from trusts.

Inherited property is not marital property. The income and appreciation of inherited property is not subject to the equitable distribution statute in a RI divorce.

An advanced degree is not a marital asset. A professional’s license such as as a lawyer’s license to practice law is not a marital asset.

Can property, which was originally non-marital separate property, be converted to marital property?

Yes. The Rhode Island divorce case of Quinn v Quinn is the seminal RI case pertaining to doctrine of transmutation. The doctrine of transmutation can change the character of non marital property to marital property.

In Quinn v. Quinn, 512 A.2d 848, 852 (R.I. 1986), the Rhode Island Supreme Court stated that the “transfer of non marital assets from one spouse to both spouses jointly, in the absence of clear and convincing evidence to the contrary, will be understood as evincing an intention to transfer the property to the marital estate. This doctrine, known as transmutation, is consistent with the recognition that marriage is a partnership … The provisions in 15-5-16.1 are designed to achieve that end. Oliviera v. Oliviera

“In Quinn, the husband placed the proceeds from the sale of his inherited property, first, into a jointly held Certificate of Deposit and, then, ultimately, into a joint account. We held that this action evinced an apparent consent to the wife’s demand for an ownership interest in the funds. The husband then used a portion of those funds to acquire a piece of realty, which he held jointly with his wife. We said that “[s]uch an act [was] consistent with, and indicative of, an intent that the parcel become part of the marital estate.” Oliviera v. Oliviera

If one spouse transfers non-marital property to the other spouse in joint names then that will usually change the property to marital property. However, the spouse can by clear and convincing evidence prove that the spouse did not intend to create an ownership interest in the property. There is, however, a rebuttable presumption that the transfer was intended to gift the property to the other spouse.

Commingled assets

If a marital asset and a non-marital asset are commingled and used to purchase or exchanged for other property then the new asset constitutes marital property.

Personal Injury Settlements and Car accident Claims in RI

A personal injury settlement or judgment for pain and suffering, future lost earnings and reimbursement for future medical bills are not marital property in RI. Awards for past medical expenses and past lost wages for a personal injury, slip and fall or workers compensation claim are marital property .Workers compensation awards compensating disfigurement is not marital property.

Are Social Security, SSI benefits or SSDI Benefits Marital property?

Social security benefits are not marital property.

If I hit the lottery after the Divorce Trial or Nominal Hearing but before entry of final judgment does my spouse get an equitable share?

Yes, surprisingly assets acquired after trial but before entry of Final Judgment are marital property.

All assets acquired up to entry of final judgment are marital assets unless the parties entered into a property settlement agreement stating specifically that those assets are non-marital.

As a former refugee desperately trying to become a free man, Pvt. Saw Blu celebrates his freedom this 4th of July as a solider in the United States National Guard. Each evening, Pvt. Saw Blut reads his bible and prays, thanking his God for life, freedom and asks for a chance to help others. Just three years ago, Blut was granted asylum in the United States through the United Nations High Commissioner on Refugees (UNHCR) and was resettled in Grand Rapids, Mich.

Blut, a member of the Karen ethnic group, fled Myanmar (Burma) to Malaysia to escape oppression and ethnic cleansing by the Burmese government. He lived in a refugee camp for two years until he registered with the UNHCR and paperwork was finalized.

“The soldiers would come into our villages, kill and terrorize our people and burn our houses,” Blut said.

While his parents survived past attacks, Blut said some of his extended family members didn’t make it. Coupled with the 2004 Indian Ocean tsunami that ravaged Myanmar and southeast Asia, Blut said he and his parents are lucky to be alive. Blut grew up in a rural, poor village near Pathein, the fourth largest city in Myanmar. Modern conveniences such as plumbing, electricity and paved roads are considered luxuries. Even before the tsunami, communication was limited. Blut said he speaks with his parents several times a year on a shared line, but disconnections and interference on the line make it difficult to keep in touch. That’s where he said their common Christian faith ties them over the miles and separation. Blut said his parents miss him but are glad that he’s safe and has an opportunity to prosper as an individual.

Over the past five years more than 15,000 Burmese refugees have found asylum in the United States and Blut said he is blessed to be one of them. He received his green card from the U.S. Citizen and Immigration Services in 2008, but now as a member of the Army National Guard, Blut is eligible to receive expedited citizenship. He said he looks forward to the day that he becomes a naturalized U.S. citizen.    

Blut enlisted in the Michigan Army National Guard in the spring of 2011. He earned his GED through the National Guard GED Plus program in North Little Rock on June 21, 2011 and reported for basic training at Ft. Jackson, S.C. the following day. Upon graduation, he will attend the Wheeled Vehicle Mechanic School at Ft. Jackson to learn his military occupational skill. Blut said he plans on returning to Grand Rapids, Michigan to attend college and find a full time civilian job.

“America has given me so much,” Blut said. “I just want to give back and serve my new country.”

Freedom of speech is the right to express one’s self. By expressing your opinion, your morals, beliefs and background are exhibited. This expression characterizes people as distinct individuals while strengthening their creativity, values and influence on others. Nevertheless, a person’s influence, or rather, vocal opinions may offend the populace. Even so, is it right to stifle freedom of speech in order to create the illusion of a perfectly uniformed society?

For tertiary level schools, colleges strive to become like Ivy League Universities; even if it means controlling a person’s rights under the banner of suppressing future upheavals and the degradation of society, diplomatically. Consequently, lower tier schools still insist on imitating the Ivy Leagues, spreading the belief that suppressing freedom of speech is necessary on campus. Students who do not obey campus rules are given demerits, expelled and/or used as deterrent.

Enrolling in college is a privilege not a right. For many to be cast aside from failing college leads to several social stigmas as well as severe feelings of rejection, imperfection and inferiority. Thus, students are forced to relinquish their rights of: free speech, freedom to practice religion and peacefully meeting together to demonstrate. Students who comply with school policies with little to no demeanors receive additional points towards their GPAs. Theoretically, these students, over a period of time exhibit habitual behavior and a way of life is created, becoming robotic.

This new collegiate ‘program’ defeats the purpose of going to college. Essentially, obtaining a college education represented a reinforcement of students’ communication system while exposing them both to a new way of learning. Going to college also meant becoming emotionally and financial secure while ensuring the continued success of each student’s country of residence. Nonetheless how can college students improve society and frame a better future when they live in fear of bigotry and failure?

If schools continue to yield to the desires of censoring speeches on campus, they run the risk of altering courses, closing minds, limiting the ability to learn, grow and experience on an international stage leaving the students oblivious to various important social issues. The future generation will be less intelligent than their ancestors creating a stagnant society. As well as portraying a failing tertiary educational system and a possible upheaval from the pressure of authorities. The students of today will be the clones of tomorrow.

Alternatively, although censorship is necessary for protecting the rights of certain groups, a distinction needs to be made. Realistically, this accomplishment is more difficult than it appears as the “little” adjustments to society could lead to further demands and uniformity. By controlling a person’s ability to state their opinions, you remove their self-awareness and identity. Subsequently, with no ability to protest, the authorities can take advantage by taking away other human rights.

Censoring speech is a complicated situation as there are many variables involved that can impact the future generations. If schools persist to succumb to the desires of special interest groups, they run the risk of narrow-mindedness, segregation and a distraught society.
