Voting for Egypt’s parliament began on November 27th, amid widespread concern for the state of its democratic transition nearly nine months after massive demonstrations in Tahrir Square. Among the questions that will animate discussions over the next six weeks of voting: What is the state of the constitutional process? How powerful will Egypt’s Muslim Brotherhood be in the new Parliament? What will be the future role of the Armed Forces? Can the United States and the wider international community play a constructive role in strengthening Egypt’s transition to democracy? Both Michael Wahid Hanna and Thanassis Cambanis have extensive experience analyzing and commenting on Egyptian politics, and will have just returned from observing events on the ground in Egypt and will be able to provide up-to-the-minute analysis of these key issues.

Thanassis Cambanis is a journalist who has covered the Middle East for nearly a decade. Michael Hanna focuses on issues of international security, human rights, post-conflict justice and U.S. foreign policy in the broader Middle East. He has served as a consultant for Human Rights Watch in Iraq and as a senior fellow at the International Human Rights Law Institute, where he conducted research on post-conflict justice, victims’ rights under international law, and the Iraqi High Criminal Court. From 1999 to 2004, Hanna practiced corporate law. Before law school he was a Fulbright Scholar in Cairo, Egypt where he undertook research on the relationship between Egyptian nationalism and Arab nationalism in the inter-war period.

If you are charged with a victim less crime (driving without a license, possessing drugs) How do they prosecute you without violating the constitution?

You have the right to an impartial judge and impartial jury of your peers. So if it is the “STATE” VS YOU. (the state meaning the people of) and the judge is from the state and the jury is also. That would violate your rights protected by the constitution. The victim cannot be the judge and the jury and your attorney too. Waiting for some smart answers!

All criminal acts are the State v. The Defendant. The judge takes an oath when taking office that he will be impartial. The jury of your peers would be people from your state.

According to the Committee to Vindicate Valerie Carlton, in 2009, Valerie Carlton, a 40-year-old-mother, was indicted on 28 charges, including 15 felonies and incarcerated at the Harford County Detention Center where she was held on $ 10 million bail (Harford County Circuit Court Case #12K09000935 at http://casesearch.courts.state.md.us). According to court documents, after she had spent 13 months in solitary confinement, the County dropped all but one of the charges for lack of evidence, a misdemeanor protective order violation for sending an email to her daughter’s teacher.

Ms. Carlton now sits in jail in Rockland County, NY, awaiting extradition to Maryland on an assault charge that involved a scuffle with a guard during her incarceration (Harford County Circuit Court Case #12K10000473). Her supporters allege she is the victim of civil rights violations and a criminal justice system gone awry. They believe freeing her will require swift action and 10,000 signatures on a petition to Governor Andrew Cuomo. Ms. Carlton’s supporters allege that the 27 charges that were dropped for lack of evidence stemmed from a bitter divorce and custody battle (Harford County Circuit Court Case #12C04000452 at http://casesearch.courts.state.md.us) in which her ex-husband Russell Carlton was awarded custody of the couple’s daughter in 2007 even though, just a year before, he was convicted of domestic violence against Ms. Carlton (Bel Air District Court Case #4R00048668). His conviction was overturned on appeal (Harford County Circuit Court Case #12K05002327).

Ms. Carlton’s supporters allege that Russell Carlton is now seeking to terminate Ms. Carlton’s visitation and parental rights with their six-year-old daughter by bringing false allegations of sexual abuse against Ms. Carlton, who has not seen or spoken to her daughter in almost three years.

While in solitary for 13 months in the Harford County Detention Center, Ms. Carlton and at least four witnesses allege she was routinely tortured and abused. According to court documents, toward the end of her incarceration, she was allegedly accosted by a male guard who admitted that he put his hands on her, with no other guards present, in an attempt to lead her back to her cell. However, the following day, the guard allegedly changed his story and claimed that Ms. Carlton stabbed him with a pen when he tried to lead her to her cell. Regardless, she was charged with an assault against the guard, despite videotaped evidence showing that he tackled her, pummeled her, and smashed her head into a concrete wall three times.(http://youtu.be/oQN1jWn5P0Q).

Ms. Carlton was released from jail on June 30, 2010, pending the trial on the assault charge. Fearing for her life and safety, she traveled to New York and was subsequently arrested by U.S. Marshalls, leading to her current incarceration in the Rockland County jail.

A nationally recognized independent forensic psychiatrist, Dr. Mark J. Mills, strongly recommended (http://dl.dropbox.com/u/17180901/Affidavit%20from%20Psychiatrist%20for%20Valerie%20Carlton.doc) that Ms. Carlton not be kept in the Harford County Detention Center in light of the abuse she claims she has suffered there. This written recommendation was provided to Governor Martin O’Malley of Maryland. However, no action was taken to prevent Ms. Carlton from being returned to the jail.

According to Philip Murphy, Esq, an attorney working on the case, she currently faces a potential sentence of up to ten years for assaulting a guard (Harford County Circuit Court Case #12K10000473). Yet, despite a videotape of her altercation with the guard and the fact that she was originally incarcerated with no evidence, no Maryland agency has examined the case, and she therefore awaits extradition while NYS Governor Cuomo’s office investigates the matter.

On November 16, Rockland County Court Judge William A. Kelly denied bail for Valerie Carlton (County Court of the State of New York, County of Rockland, In Re the Matter of the Extradition of Valerie Carlton, the Judge is Hon. William A. Kelly, Supreme Court Justice) and postponed a decision until December 8th.

Punjab Pakistan The population of the province is estimated to be 86084000 in 2005 and is home to over half the population of Pakistan. The major language spoken in the Punjab is Punjabi (which is written in a Perso-Arabic script in Pakistan) and Punjabis comprise the largest ethnic group. The language is not given any official recognition in the Constitution of Pakistan. Punjabis themselves are a heterogeneous group comprising different tribes and communities, although the different castes in Pakistani Punjab has more to do with traditional occupations such as blacksmiths or artisans as opposed to rigid social stratifications. The most important tribes within Punjab include the Muslim Rajputs, the Gakhars, the Gujjars, the Jats (see also List of Jat Clans of West Punjab), the Dogar, the Arain, the Punjabi Shaikhs and the Syeds. Other smaller tribes are the Awans, Rawns, Pukhtuns, Baloch, Afghans and the Maliks. Other smaller ethnic groups in the province include the Siraiki, Hindko, Kashmiris, Sindhis, and Muhajirs. Three decades of bloodshed in neighbouring Afghanistan have brought a large number of Afghan refugees (Tajik, Pashtun, Hazara and Turkmen) to the province. The population of Punjab (Pakistan) is over 99% Muslim with a Sunni majority and Shia minority. There are small non-Muslims groups of Zorastrians, Bahá’ís, Christians, Sikhs,Hindus and Ahmadiyya communitiy. New York Law School (NYLS) and John Jay College of Criminal Justice, City University of New York, announced today the creation of a dual-degree M.A.-J.D. program in forensic psychology and law to train attorneys with a specialization in mental disability law. The program will begin in the fall 2012 semester.

The new dual degree brings together two fully-developed programs at each institution: the J.D. at NYLS and the M.A. in forensic psychology at John Jay. J.D. students at NYLS have the opportunity to specialize in mental disability law, through course offerings that represent the most comprehensive mental disability law curriculum of any law school in the world, while John Jay’s M.A. program in forensic psychology specializes in psychology as it relates to law and the courts. John Jay’s psychology department includes more than 35 full-time faculty members who specialize in forensic areas, including six professors who are both attorneys and psychologists.

“This new program is a perfect fit between our two institutions, as it combines the strongest law program specializing in mental disability law in the country, with the strongest forensic psychology program in the country,” said Dr. James S. Wulach, Director of the M.A. Program in Forensic Mental Health Counseling at John Jay. “Our graduates will be well-trained lawyers for people with mental disability issues and have the potential to become legal advocates, work on public policy, or become law professors in this unique niche.”

The 128-credit program allows students to count 12 law school credits towards their M.A. degree and 12 M.A. credits towards their law degree, allowing them to graduate with both degrees in four years instead of five. Required courses include Survey of Mental Disability Law; Mental Health Professionals, Social Science, and the Law; Criminal Psychological Assessment; Criminal Law; and Legal Practice. Electives include such courses as Mental Disability and Criminal Law; Race, Gender, Class, and Mental Disability; Forensic Reports, the Role of Experts, and Forensic Ethics; and Custody Evaluations, Juvenile & Family Law, and Mental Disability.

“I’m very excited about the joint program because it highlights the interdisciplinary nature of what we are trying to do through our Mental Disability Law Program [MDL],” said Professor Michael L. Perlin, the MDL program’s Director. “We created our courses very specifically to appeal to both lawyers and mental health professionals. This program helps create a synergy that ensures, as best as we can, that graduates will have a deep understanding of the other’s discipline.”

To be admitted into the dual-degree program, students should apply separately and be accepted into both NYLS and John Jay. Students will have the option of beginning their first year in either of the two degree programs.
