Only the Sovereign (People) as defined in the Preamble can claim the rights as described in the Bill of Rights. Citizen’s are under the jurisdiction of the United States, thus have no rights under the US constitution. The People are sovereign not the citizens. Eric Whoru explains it in this call.

It is each one of the People that is a sovereign.
On the other hand, a “citizen” is a created role and office that is subject to some Body (such as the United States, United Kingdom, Canada etc).
As such, you can stand as one of the sovereign people, whereas saying you stand as a “sovereign citizen” is an oxymoron as a “citizen” is a subject – i.e. the opposite of a sovereign.
Stand free and sovereign as one of the People – with un-a-lien-able rights and freedoms at common law.
