C. Establishment clause and free exercise clause. This means that government (1) can’t establish an official religion for the country and (2) can’t make any laws that affect the free exercise of religion.

There is a religious tests clause in the Constitution itself, saying that there can be no religious tests to hold office, meaning that you can’t be excluded from holding office if you belong to, or don’t belong to, any particular religion.

Looking forward for constitutional amendment bill

The Centre finally makes it clear that it is not possible to bring Aviation Turbine Fuel (ATF) under the scope of the proposed Goods and Services Tax (GST), as per the model suggested by the states.

 

The Oil Industry came out with a demand to include crude oil and its products, and natural gas in the upcoming GST regime. We often used to see different fuel prices from states to states and the main reason for this is the different tax rates structure followed by the states according to their budgetary targets.

 

Earlier our Finance Ministry proposed to keep crude oil, petrol, diesel, ATF and natural gas permanently outside GST through a Constitutional Amendment. There are many states in India who heavily depends on collections from levies on oil products to make up for their budgetary targets. So this has been proposed basically to protect the finances of states. However, recently a letter has been written by the Petrofed, a body representing both public and private sector companies like Indian Oil Corp, seeking inclusion of crude oil, petrol, diesel, aviation turbine fuel (ATF) and natural gas in the Goods and Services Tax .

According to Petrofed, the inclusion of petroleum products under GST will eliminate twisted wires of taxes paid by suppliers as well as by the industry at different stages in the petroleum value chain. Further, it will also enable the States and the Centre to capture full revenue potential up to sale to final consumers.

 

The 13th Finance Commission has also recommended that petrol, diesel, ATF, crude oil and natural gas should form part of GST legislation. Even it has also recommended that, if necessary, an additional tax can also be levied on these commodities in addition to the GST to look after the financial concerns of the states. But our Finance Ministry wants to keep them permanently out of the GST through Constitutional Amendment.

 

It is well known fact that a lot of things is required to be done for the introduction of the Goods and Services Tax but one thing is certain here that the Government is looking forward to continue the GST process as well as at the same time will try to develop the Consensus between the Centre and the State Governments.

The UB Post will host a First Amendment Free Food Festival on Monday, Sept. 17, Constitution Day, from 3:30 to 6 p.m. on the University of Baltimore’s Gordon Plaza. This unique, interactive event will give students and others a glimpse into what life would be like without the free speech rights — freedom of the press, freedom of speech, the right to assemble, freedom of religion, and the right to petition the government — guaranteed by the U.S. Constitution. The event is free and open to the public. Gordon Plaza is located at the corner of Maryland and W. Mt. Royal avenues.

Here is how the festival will work:


     Guests will “sign away” their First Amendment rights in order to enter a fenced-off area of the plaza, where free food, drink and other giveaways will be available to all participants.
     Select students will act as “enforcers” to demonstrate to participants what it means to live without First Amendment rights.
     In addition to the enforcers, there will be staged performance pieces to demonstrate what happens when First Amendment rights are taken away.

Nedra Cruz, a graduate student in UB’s publications design program and editor in chief of The UB Post, said the idea for the festival came from a college newspaper convention that she attended last spring. While there, she learned that Florida Atlantic University had successfully hosted a festival about the First Amendment, and their students believed it was a good way to recognize Constitution Day. Post staff members talked with their counterparts at Florida Atlantic’s student newspaper, and Cruz and her fellow students decided to bring the idea to UB.

“We’re recognizing Constitution Day, but we’re doing it in a fun, festive way so that students can enjoy — and nourish — themselves while coming to appreciate their First Amendment Rights,” Cruz said. “Our goal isn’t to offend anyone, but we hope to enlighten the community about its rights and how they can be taken for granted. It’s hard to believe that, in the 21st century, there are still countries where citizens don’t have the freedoms that we have in America.”

The UB Post is the student-run monthly newspaper of the University of Baltimore.

Prior to the alleged ratification of the 14th Amendment, there was no legal definition of a “citizen of the United States”, as everyone had primary citizenship in one of the several states. The Constitution referred to the sovereign state citizen, and no one else. Those who went to Washington, DC or outside the several states were commonly called “citizens of the United States.” In the Constitution for the United States, the term was used to identify state citizens who were eligible under the suffrage laws to hold office, and they were required under the Constitution to have primary allegiance to one of the several states. Since that term was not specifically defined in the US Constitution, Congress in 1868 took advantage of this term and utilized it in the so-called 14th Amendment to describe a NEW type of “citizen” whose primary allegiance was to the federal government, ie Washington, DC and not to one of the several states of the union. Thus, using the term as used in the US Constitution to mislead and confuse the people as to the true intent and meaning of the Constitution. Many people have mistaken the citizen as denominated in the 14th Amendment to mean the same one in the original constitution, this is in error. The “citizen of the united states” as used in the constitution is not the same as the citizen of the United States used after the 14th Amendment. So all the elected officials are NOT sitting in the office constitutionally, they are merely impostors created

Does anyone know where, if at all, it says in our Constitution or any Ammendment that a citizen can be required to purchase a good or service in order to legally reside in the United States of America?

For instance, if the government decided that apples were good for a person’s health, can you be legally complelled to buy them? What about shoe leather, blueberries, toilet paper, or Health Insurance?
