Q&A: National Security question – for an online business ethics class?

Question by Michelle: National Security question – for an online business ethics class?
I’m in an online class for business ethics and am having trouble finding any references to this question we have. We are having an online debate via a discussion board and have been assigned roles. My role is a Republican Senator and this is the question posed:

Should national security issues be outside the realm of ethics and differentiated from the issues that arise concerning privacy in a commercial setting such as your place of employment?

If anyone can help me out that is Republican, I would appreciate it. I would also appreciate serious answers only. This debate will start in just over 2 weeks. Thanks in advance!

Answer by JAMES H
No National Security issues should not be outside the realm of ethics nor should it be differentiated from the issues of privacy. First let start by stating I am a Republican and know many Republicans. They including myself are not fearful of a Republican taking away our right of privacy. We are afraid of the Government infrenging upon our rights to be secure in our property and person. First I must answer this question by stating nowhere in the Constitution is stated there is a right to privacy. You have a right to secure in your person, property and papers. This right can only be taken away by a writ or warrant issued by a court and of course with the proper probable cause.
Second if you are an employee in a business this right does not apply. The Constitution only applies to the Government not to an individual or business. You must understand that as an employee you are using company phones, computers, space and equiptment. Therefore all that is done, stored or view via those mediums can be subjected to scruitny by the Company.
The same applies to a Business which is doing business to a Country which is contuary to the National Security of this Country. Using the Home Land Security means of investigation even a wire tap must be approved by a Judge.
If I were you I would first start with the US Constitution pertaining to the search and seizure docturne. Next I would check out the Home Land Security Bill ending with Court Rulings, and the issues concerning international commerce.

Nationwide Utility Industry Credit Union Steps Up Its Virtual Business Model

Nationwide Utility Industry Credit Union Steps Up Its Virtual Business Model

Utilities Employees Credit Union will unveil new mobile and home banking platforms powered by Jwaala, later this year.

Wyomissing, PA (PRWEB) April 12, 2012

The credit union that serves 45,000 members and 600 companies in the nation’s utility and energy sector has announced it will offer mobile banking and expand its online services later this year. Utilities Employees Credit Union (UECU) recently signed a contract with the Jwaala software company to take its suite of convenient financial “E-services” to a new level.

“UECU has always been a ‘virtual credit union’ serving a widely-dispersed membership,” says Glen A. Yeager, UECU President and Chief Executive Officer. “The upgraded online and mobile banking platforms will further empower our members and simplify management of their finances.”

Providing high-quality, nationwide account access to its member customers has long been a priority for UECU. For more than 75 years, UECU has operated without a branch system, initially handling its long-distance transactions by mail and electronic fund networks until they added around-the-clock phone banking and then online banking, in 1994 and 2001. Its virtual business model allows UECU to provide financial benefits to companies and employees in the utility and energy industry wherever they expand or relocate throughout the nation.

UECU saw an opportunity to further enhance and personalize their members’ online banking experience while adding even greater customer security, by upgrading to a system offered by the Austin based company, Jwaala. The credit union will add mobile banking and combine the free online services it currently offers – including online banking, phone line banking, online bill pay, account E-Notifications, remote check deposit, account E-Statements, internal as well as external fund transfers, and online loan applications – into a new banking platform that can be personally tailored by each member.

“The enhanced system will be more intuitive to use and individuals will be able to customize their own dashboards,” says Yeager. “At log-in, they can immediately view the information deemed most important to managing their finances on a single screen.”

The UECU organization will roll out the new platform later this year and is now planning ahead to provide members with an easy transition and to educate them about new online features. UECU members will receive added personal finance tools to track transactions, establish budgets and goals, and securely store personal documents like their receipts. Users will now be able to categorize, search, sort, and graph their financial information and account transactions. UECU will also enhance online opportunities for families to manage their financial accounts together.

La Quinta Business Attorney?s Top Ten Things That Sarah Palin Would Like Changed in the Constitution

Here is La Quinta Business Attorney Sebastian Gibson’s Top Ten:

1. No more free speech for those liberal media types.

2. Move the capital from Washington D.C. to Anchorage.

3. Free guns for everyone.

4. Religion should replace recess in all the schools and economics in all the colleges.

5. Drilling in the ANWR and off the coast of California should be mandatory.

6. Neiman Marcus should be required to open a store in Alaska.

7. Every woman should be required to have their hair in a beehive.

8. From now on, Putin shouldn’t be allowed to rear his head in the airspace above Alaska.

9. Katie Couric is persona non grata.

10. There is only one political party and the name of it rhymes with mepublican.

Now here is everything (well, almost everything) you need in business about personal injury, car accidents, brain damage, wrongful deaths, business, real estate, landlord-tenant, homeowners association law, construction, patents, trademarks, corporations, entertainment law, advertising, copyrights, and litigation without making any serious legal missteps.

If you need to know more about business environmental, international law, election and campaign law, consumer law, class actions, constitutional, internet, publishing, advertising, media, food and wine, hotel and restaurant law, estate planning, wills, trusts, water law, agricultural, insurance law, bad faith, psychologist and psychotherapist defense, education law or child accidents, you can find valuable information by searching for those subjects and adding the words La Quinta business lawyer or La Quinta business attorney to your search terms and looking for other articles by Sebastian Gibson.

You can also learn more about any of these business areas of law and how we can assist you as La Quinta business attorneys, or as lawyers in any city, by calling the Law Offices of R. Sebastian Gibson at any of the numbers which can be found on our website at http://www.SebastianGibsonLaw.com  .

1. Personal Injury, Car Accidents, Drowning Accidents, Brain Damage, Catastrophic Injuries and Wrongful Deaths in La Quinta – If you’ve had a La Quinta auto, motorcycle, truck, pedestrian, bicycle, bus, train, airplane or car accident of any kind, get the other driver’s information, take camera or cell phone pictures, call the police, get a report, seek medical treatment immediately, call us or another good La Quinta personal injury lawyer, follow up with more medical treatment if you are still hurt, report the accident to your insurance agent, file a report with the DMV and don’t talk to anyone else or give a recorded statement until you talk with us. If you’ve lost a loved on in an accident, call us or another good La Quinta personal injury lawyer immediately. If you’ve been bitten by a dog, get treatment, call animal control and then call us. If you or someone you know has come close to drowning, seek medical treatment immediately as death or serious injury can still occur hours later.

2. La Quinta Business – Put everything in writing and preferably with our help or the help of another good La Quinta business lawyer. Spend money only as you need to. A La Quinta business attorney can tell you where to save costs and how to do it without risking liability. Limit your promises to employees and to customers. Buy insurance. Protect your intellectual property at the outset. Don’t disclose your inventions or any trade secrets to anyone without a non-disclosure agreement. Incorporate as soon as you are profitable. Get legal advice for problems or indications of pending lawsuits immediately. Keep all costs, including labor costs, to the bare minimum. Always use confidentiality agreements when disclosing valuable information and be careful what information you agree to receive. Tell customers they must pay in advance or on delivery. Do not agree to bill and be paid at a date after delivery. Otherwise you won’t be paid on a percentage of your products. Be wary of the potential for fraud by customers, business partners and employees.

3. Residential and Commercial Real Estate, Landlord Tenant Law, Mortgage Law and Homeowners Association Law in La Quinta – Use a La Quinta real estate lawyer who is also a Realtor, or a Realtor who is also a La Quinta real estate attorney. Don’t buy or lease more than you need. Choose the right location. Choose the right mortgage. Don’t refinance if you think you may need to walk away from a home. Don’t buy more than you can afford. Check out the neighborhood carefully. Get a home inspection and a home warranty. Have a La Quinta real estate lawyer look over the documents. Homeowner Associations are facing a host of problems stemming from the number of foreclosures. As fees are reduced by vacant homes and condos, projects must be trimmed back or delayed in order to save money. Some homeowner associations, who were already in trouble, may face additional problems in the future and both homeowners and their associations should consult with legal counsel to help resolve how to deal with such issues.

4. Construction in La Quinta – With the construction industry in it’s biggest ever slump, down more than 90% from its peak in many areas, La Quinta contractors need to shift their focus to energy free homes, apartment construction and to take advantage of contracts likely to be offered for bid under the new administration’s plan to create new jobs rebuilding the country’s infrastructure, construction of roads, bridges, the electrical grid and other utility projects. If you are dealing with contractors yourself, always use licensed contractors and have a La Quinta construction lawyer look over your contracts. You can also investigate the contractor online to ensure he is licensed and insured and a La Quinta construction attorney can do an additional investigation at little extra cost. Never pay a contractor the entire sum for a project at the start. Put all agreements in writing, including any changes.

5. La Quinta Patents and Biotechnology – A patent should be applied for, for any new, and non-obvious process, or invention and to any new improvement of an invention at first opportunity. A patent is good for 20 years. Depending upon the complexity, most utility patent applications will cost between ,000 and ,000.00. A design patent can be applied for by a La Quinta patent attorney, for the look of an item and is good for 14 years. A provisional patent can be applied for, good for one year at a cost of half of the usual utility patent cost but is only good for one year. If the inventor does not upgrade the provisional patent into a utility patent application within that period, usually for the cost of the remainder of the corresponding cost of a utility patent, the inventor loses his or her protection. A patent is pending once it has been applied for, and can be licensed, or sold outright. Without a patent, others can make and sell your invention with no compensation to you. Patent searches help the La Quinta patent lawyer write an application around existing patents and cost an additional sum, usually under ,000.00. Drawings must also be prepared for the patent application usually for under 0.00. A design patent can be sought for between ,000 to ,500 and a European design patent for between ,000 to ,500. Accelerated patent applications usually cost an additional 50% of normal patent applications. Foreign patent applications also require additional fees.

6. La Quinta Trademarks – Trademark any original logos, designs, words, phrases, symbols or combinations that you use to identify your products or services as soon as possible. Call a La Quinta trademark attorney as soon as anyone else’s trademark or service mark is so similar as to cause a likelihood of confusion in the public or if you receive a cease and desist letter from someone else accusing you of infringement. Trademark applications range from between ,500 if there has not yet been any use of the trademark to ,500 to apply for a trademark already in use. Therefore, to save money, create some products and advertising materials and apply for the trademark once they are ready to be sold and advertised.

7. La Quinta Corporations – Never incorporate by yourself. Corporations will not protect you from liability if you do not follow corporate formalities correctly. Protect your intellectual property from the start with the help of a La Quinta corporations attorney. Don’t borrow someone else’s employee handbook or fire problematic employees without legal advice. Don’t get investors without seeing one of our La Quinta corporate attorneys. Cut costs to the bone. Use extra money to advertise, and sell in new markets. A La Quinta corporations lawyer can provide you with advice as to which type of corporation or LLC to use for your business.

8. Entertainment Law, Sports Law, Marketing, Advertising, Media and Copyrights in La Quinta – Whether you are a musician, an actor, a model, a writer, an athlete, a broadcaster or connected in any other way to the entertainment industry, contact us or another good La Quinta entertainment attorney as soon as anyone gives you a contract to sign. Signing a bad contract can end your career before it’s ever begun. As soon as you have written any body of work, have it copyrighted. You can do this quite easily yourself, but if you need assistance or if someone else infringes your copyrighted work, you can then file suit against such a party.

9. La Quinta Litigation – At the first sign that someone may sue you or your business, consult with a La Quinta litigation attorney. Many times, a lawsuit can be forestalled before it has been filed or the matter resolved with letters between the litigation attorneys. If you are served with a lawsuit, hire a La Quinta litigation lawyer like one from our firm who specializes in mediations and non-binding arbitrations so your litigation can be resolved at the soonest possible opportunity and limit your exposure to years of lawyer’s fees and costs as your case winds slowly through the courts.

10. Employment Law in La Quinta – It may seem silly to think you should hire a La Quinta employment attorney whenever you are considering firing an employee, but it has come to that. However, a consultation with a good La Quinta employment law firm can provide you with the advice of how to handle your employee relations both immediately and in the future as you either seek to cut costs or get rid of a problematic employee. If you have been sued or threatened with a suit, or are being scammed by an employee, consult a La Quinta employment lawyer immediately.

Organizations Answering President Bush’s “Call to Service” on the Tammy Says… Show – USA Freedom Corps & Business Strengthening America

Organizations Answering President Bush’s “Call to Service” on the Tammy Says… Show – USA Freedom Corps & Business Strengthening America

Washington, DC (PRWEB) October 20, 2004 –

– USA Freedom Corps, a coordinating council housed at the White House and chaired by President George W. Bush, and Business Strengthening America, the business community’s self-directed, non-partisan response to the President’s national “Call to Service”, will be on the Tammy Says… show on Monday, October 25th. Both organizations mission is to promote a culture of volunteerism (both workplace and civic), to get people engaged, or deepen their involvement in the community. The companies that have answered the “Call to Service” share a core belief that an increased commitment to volunteering and civic responsibility not only builds stronger communities, but it also helps businesses to “do well by doing good.”

According to the Bureau of Labor Statistics, volunteerism is on the rise with approximately 63.8 million Americans volunteering last year, up from 59.8 million the year before. Of this total number, 31.2% of employed persons volunteered. Many of the Fortune companies as well as small to mid-size companies have Community Service programs and departments which promote volunteerism efforts. Post 9-11 transformed this country from an “it’s all about me” culture to a culture of service and citizenship that looks like it is going to last. In fact, even the Tammy Says… show has volunteers who work for the greater cause: to bring information like this show to our audience.

Tammy Camper, Host of the Tammy Says… show says “after meeting with both USA Freedom Corps and Business Strengthening America, I knew we had to do a show on the amazing efforts of these two organizations. Not only does this help the communities where the efforts are being done, but on a deeper level, it brings big business and small business together on a different playing field.”

Business Strengthening America is a self-directed effort to engage thousands of America’s business leaders, from Fortune 500 corporations to small locally owned businesses, in a campaign to strengthen American society. USA Freedom Corps leads the efforts of more than 40 programs and initiatives that enable more Americans to serve those in need close to home and in countries around the world. Among these programs and initiatives are the Citizen Corps, Senior Corps, the Peace Corps and Volunteers for Prosperity. The “Call to Service” has been answered by the thousands through increased volunteer service, strengthening National Service programs, strengthening Homeland Security and emergency preparedness, recognition of dedicated volunteers, and challenging businesses to strengthen America.

About USA Freedom Corps

USA Freedom Corps is a Coordinating Council housed at the White House and chaired by President George W. Bush. The Council was developed as a “Call to Service” by President Bush to strengthen the culture of service and help find opportunities for every American to start volunteering. USA Freedom Corps has engaged thousands of organizations and millions of Americans in volunteer service since 2003. For more information on USA Freedom Corps, visit http://www.usafreedomcorps.gov.

About Business Strengthening America

Business Strengthening America (BSA) is the business community’s self-directed, non-partisan response to the President’s national “Call to Service”, which asked every American to give the equivalent of two years time, over a lifetime, in service to others. Launched in December 2002, BSA both promotes corporate practices and policies that support expanded service, and mobilizes businesses to support volunteer service and civic engagement. BSA aspires to make service to the community an integral part of American business culture. Nearly 800 companies and business organizations representing over five million employees are BSA members. The Last Hope for America is a Home Based Business!

Are you sitting there at your desk, in your cubicle imagining what it would be like to have the time and financial freedom to do exactly what you want when you want to? Well, you are not alone. Most people are thinking the exact same thing as they schlep through their day. The question is HOW to actually make this dream happen?

The answer for many people is by working at home with their own home-based business. There are several things to consider. Say you made the decision you would like a home-based business. Great, this is the first step. Next you have to figure out what kind of business you want, and there is no shortage of opportunities out there! It is very important you get clear on what you want out of a business and find an opportunity that matches with what you want and can get excited about. It’s pretty common sense, but if you are not passionate about what you are doing or promoting, your chances of success are not very good.

Next, it is important to do your research on the opportunities you are considering. The reality is that most of what you see are scams. There are so many good opportunities as well, but for someone who is just starting out in the home-based business journey, they have to be especially careful. Find leaders and mentors who have achieved the level of success you are looking to achieve, and have them train you. Everyone who has ever made it big in anything always had a coach or someone beyond where they were to help them along the way. I don’t care what you are considering, if it is an area that you don’t know much about and want to improve in, it is essential you work with people who are successful in this area to show you the ropes.

The Home-based business industry is exploding and is just going to get hotter and hotter. More and more people are wanting to have the financial freedom and control of their own time that working from home brings. According to a recent article in Forbes Magazine, in the next 3-5 years, there will be 79 Million Americans looking to start a business…imagine that! That’s a revolution if I ever heard of one! We are seeing that we have to take control of our own financial futures in order to live the lives of freedom we know we deserve!

Here is the bottom line: 1. Find a real opportunity with a rock solid foundation for long-term success. 2. Find some mentors and leaders who have achieved the level of success you want in your life and can show you step-by-step what to do. I guarantee you if you try and figure it out on your own it will take you so much longer, and your chances of success are pretty slim. 3. Be excited and passionate about what you are doing, whatever it is, because in the moments when it gets tough and things seem impossible, it will be this excitement and vision that will get you through. 4. Have FUN! Yes, it is going to be some work on your part, but it does not have to be a huge struggle…you are building your life the way you want it to be, and if that is not fun, then you are doing something wrong!

Job security is a total joke. Having a job is actually MORE risky than being an entrepreneur. We are waking up to the reality that many of our jobs are not going to be around much longer. We are seeing that our companies and our government is not going to take care of all of our needs, like we once thought. Many of us are waking up to the reality that we have to take charge of our own economic future, because our companies or our government is not going to take care of us. We will do best by taking care of ourselves! How? By becoming an entrepreneur and starting our own home-based business! This is the major trend of where we are headed anyway, the age of the entrepreneur!

There are many things to consider when looking for an opportunity. Of course, you can always create your own, but if you are like most people, you want to find an existing opportunity that already has some momentum. Do your due diligence and take your time to research the opportunity you are looking at, because there are a lot of scams out there. It is important you find something that you can get passionate about as well as finding mentors and leaders who have achieved what you want to achieve and can show you step-by-step how to accomplish your goals.

By taking the steps to become an entrepreneur, you are taking charge of your life and creating your financial future. Your results are dependent upon you and your productivity. There will be no boss breathing down your neck to get stuff done. You are the one who is in control of your schedule and have complete control of every aspect of your business. This is a very exciting process, and can be a transition for some people, because many of us are so conditioned with a job mentality…we are conditioned to wait for someone tell us what to do. Making this transition into becoming a self-sufficient entrepreneur can take time, but is essential to thrive in our changing economy and world.

If you haven’t already, I would strongly encourage you to find a home-based business that works for who you are and what you want out of life. If you are working full-time, find one you can do part time in your home hours. There are so many benefits of having a home-based business that you don’t have as an employee. Specifically I am referring tax structures, income potential of being a business owner vs. an employee, control of your own time, being your own boss…the list is endless!

GO FOR IT!

La Quinta Business Lawyer?s Top Ten Things That Sarah Palin Would Change About the Constitution

Here is La Quinta Business Lawyer Sebastian Gibson’s Top Ten:

1.The Vice President is in charge of the Senate.

2. The President must be a woman.

3. No more interviews of politicians.

4. The democratic party is outlawed.

5. Only one news channel – Fox News.

6. Any more fake calls from disc jockeys pretending to be the President of France and Canada is out of NAFTA, whatever those initials stand for in the constitution.

7. All turkeys are pardoned.

8. Snowmobiles should be used in place of cars throughout the U.S.

9. Anytime a woman is elected governor in Alaska, she automatically becomes the President two years later.

10. Rewrite the whole darn constitution with PTA moms in charge this time.

Now here is everything (well, almost everything) you need to know in businessabout environmental, international law, election and campaign law, consumer law, class actions, constitutional, internet, publishing, advertising, media, food and wine, hotel and restaurant law, estate planning, wills, trusts, water law, agricultural, insurance law, bad faith, psychologist and psychotherapist defense, education law and child accidents.

1. Environmental and Toxic Tort Law in La Quinta – With multi-billion dollar energy companies spending more money to confuse the public on the threat posed by global warming than on research into alternative forms of energy, it will take all of us to sort fact from fiction and solve the growing problem of global warming. An additional danger to all of us comes from exposure to toxic materials in our daily lives from tainted food, to contaminated ground water, to dangerous viruses in the public and in hospitals to lead and mercury poisoning. If you experience unusual symptoms that a doctor can’t explain, you may have been exposed to a toxic substance and have a toxic tort claim that should be evaluated by us or another qualified La Quinta environmental attorney.

2. La Quinta International, Shipping and Maritime Law – A La Quinta international attorney with years of international legal education and experience such as you’ll find at our La Quinta law firm, can provide you with a wealth of practical knowledge and the ability to find answers to your international law questions. It is to your advantage to also have a La Quinta international lawyer working in cooperation with foreign counsel in other jurisdictions to ensure that the most cost-effective avenues are pursued to resolve your legal matter. However, many international matters can be resolved with letters between La Quinta international lawyers and foreign lawyers, and international mediations and arbitrations can also be utilized. If you have been injured on a ship or an oil rig you have rights under the Jones Act to be compensated for your injuries, medical treatment, past and future wage loss and care.

3. La Quinta Election and Campaign Finance Law – If you are considering running for political office or have already done so and are facing campaign finance legal issues, the time to hire a La Quinta election attorney with election law knowledge is at the first possible opportunity before you get into hot water that can sink your campaign or put your political career into jeopardy.

4. La Quinta Consumer Law and Class Actions – If you have paid for an item but have not received it, been promised an action or service that has not come to fruition or are considering ordering services or signing any type of agreement, the time to hire a La Quinta consumer lawyer is immediately in order to avoid being scammed, or defrauded. A La Quinta consumer attorney’s letter drafted forcefully but professionally will obtain the desired result, products or services in a good percentage of cases. Whether you ordered gold bars but did not receive them, were told that your car would be paid off when you traded it in on a new one or were promised that a pool would be completed in your back yard, a La Quinta consumer attorney can and should be hired for a modest fee to write a letter on your behalf and demand the required action, products or services. If you think you are just one of many who have been scammed or defrauded in some way, you may have a class action.

5. Constitutional, Publishing and Publicity and Privacy Rights, Internet Law, Advertising and Media Law in La Quinta – Defamation includes both libel and slander. Anyone in the media or publishing or broadcast world or with a web site is at risk of a lawsuit for claims of defamation or false advertising However, constitutional law questions also arise in civil rights discrimination cases, discrimination in employment and a wide variety of other legal matters. If you have been disenfranchised or your constitutional rights abused in any matter or if you have been accused of abusing the rights of others, contact a La Quinta constitutional lawyer as soon as it occurs. If others seek to profit with the use of your name or image you also have a claim for damages.

6. Food and Wine Law, Hotel and Restaurant Law in La Quinta – Today, hotels, restaurants, nightclubs, bars and grocery stores face an ever increasing host of new regulations they never faced previously. From the usual licensing problems they face with the Department of Alcoholic Beverage Control for adherence to and violations of ABC rules, to new state regulations involving menus and calorie counts in fast food restaurants and new rules requiring groceries to show the country of origin in labels on most of their produce and meat. The worst case scenario today for an establishment serving alcohol, is to serve a minor alcohol who later dies in an auto accident. Such an establishment will need legal representation by a La Quinta food, alcohol and restaurant lawyer before the ABC as well as legal defense of civil lawsuits filed against it.

7. La Quinta Estate Planning, Wills and Trusts – The current estate tax in 2008 affects only people who die with an estate in excess of two million dollars. In 2009, that amount will increase to three and a half million dollars and in 2010, the estate tax is repealed. That’s the good news. If, however, the estate tax repeal is not extended by 2011, the estate tax will kick in again. The worse news is that in 2011, if the estate tax repeal is not extended, the estate tax will kick in at one million dollars. The current federal estate tax rate is a whopping 47 percent. That stays the same in 2009. But other current provisions in the tax code change or end in 2010. In light of this, it is more important than ever to hire a La Quinta estate planning lawyer to draft your will and evaluate the need for a living trust to avoid probate fees ensure your estate goes to the beneficiaries you want it to go to. If you don’t have a will or trust at death, the state will determine who gets your estate, but it will usually be your spouse and children, of if you have none, your closest relatives.

8. Water, Agricultural and Natural Resource Law in La Quinta – It is hoped by American farmers and meat producers that the new Country of Origin Labeling Law taking effect in groceries will cause food shoppers to seek meat and produce from the U.S. over food items from other countries. But it is the water shortage in California that has California farmers faced with dire consequences. In 2008, the California Governor formed a Water Bank to stave off mandatory water rationing, but if California has another dry winter, or more fires that draw upon California’s precious water reserves, or if the state legislature does not address the state’s delta environmental problems and expand the state’s water works, with a bill that has been tied up while the legislators haggled over a budget, rationing across the state could become a reality. If you have a water or agricultural issue, the time to call a La Quinta agricultural lawyer with knowledge in this areas is before the issue becomes critical.

9. Insurance Law, Bad Faith, Psychologist, Psychiatrist and Psychotherapist Defense in La Quinta – As insurance companies feel the pain of the stock market crash and face the reality of the value of their own investments decreasing, we expect to see insurance companies delaying settlements, and flirting with violations of the insurance bad faith statutes. As the public becomes more and more depressed with the sinking stock market, loss of jobs, reduced income and less enjoyment out of life, we also see the likelihood of greater use of psychiatrists, psychologists and psychotherapists. When claims are made against these professionals without justification, our La Quinta law firm stands ready to defend them

10. La Quinta Education Law and Child Accidents – A recent court ruling in California has given temporary relief to parents homeschooling their children. However, we still expect further court rulings to make guidelines that will govern when or under what circumstances homeschooling of children will be permitted in California. Children, as any parent knows, can be injured any time, anywhere. What should not happen is any injury to a child that is the result of the negligence of another. To that end, our La Quinta personal injury lawyers championed protection for children and convinced at least one court and encouraged other personal injury attorneys to do the same, to uphold a new tort for negligent endangerment of a child.

Building vs. Renting: What’s Best for My Business?

Many businesses grapple with the decision of whether to find several Minneapolis general contractors and build a space, or to simply rent an office. The decision will largely depend on the stability of the specific business, the current and future needs and the business’ financial state.

Primary Advantages for Building Commercial Space

Having the stability of ownership is a major benefit for companies looking to buy commercial real estate. You can partner with a reliable Minneapolis general contracting firm to build the office of your dreams and have it for years to come. Additionally, there are no lease terms, meaning you won’t have to renegotiate or pick up and possibly move every few years as a renter would. You can establish yourself in the business community and make a name for yourself.

Financial Benefits to Building

One of the most obvious benefits to buying office space is the fact that the building is an investment. Partnering with the right commercial construction company that can build a beautiful and functional space can pay off in the long run. Depending on market conditions, you may also be able to make a return on your investment when it’s time to sell. Additionally, if you need to move on but don’t want to sell your property, you can rent it out to another company and draw additional income.

The government gives buyers tax breaks for interest, depreciation and property tax deductions, which is another added benefit to buying instead of renting commercial real estate. Additionally, sometimes there are added tax credits for first-time buyers.

Like other areas around the country, the Minneapolis commercial construction sector has plenty to offer businesses looking to increase their property portfolio options. Investing in commercial real estate is a great way to diversify your portfolio.

Disadvantages to Building a Commercial Property

The closing costs for buying commercial real estate can be sky high, and for a business not financially stable that can be a big problem. Similarly, for a business not fully prepared to buy, property taxes can prove burdensome. It is important to ensure that your company is fully capable of handling all of the costs associated with buying.

Financial Benefits to Renting

Although you aren’t building equity in your leased space, there is also some financial benefit to renting. If something goes wrong in your building, you won’t have to foot the bill for calling a general contracting company to come out and make repairs, which could be costly.

Additionally, you won’t have to pay property taxes or city assessments, which can be a financial burden to companies that aren’t fully established. Perhaps one of the most evident benefits to renting is that your company isn’t subject to the whims of the financial and housing markets. A market crash can send your property values plummeting, and as a renter, you won’t have to worry about losing an investment.

Additional Benefits for Renters

With so many options available in commercial construction, it can be difficult for a business to definitively settle on a particular location. Another advantage to renting is the freedom that it allows. If after several years at one property, your business decides to move, it is much easier to do so as a renter.

Disadvantages to Renting

While renting does have some benefits, one major drawback is the lack of control you’ll have over your property. You are only assured of the space for the term of your lease, and, even if you re-sign your lease, your rate could go up significantly.

Startup costs to renting can sometimes be equally expensive. Deposits typically include first and last month’s rent, paid up front and your landlord has the right to increase rent at any time, so there is not much control in that area of finances either.

For those grappling with this decision, it will largely depend on factors like how current stability of the business, it’s needs and desires, as well as it’s financial capabilities. Ultimately, these factors will determine the outcome of whether or not finding some Minneapolis general contractors is the right choice for you.

OnlineAdviser Competes in Business Plan Competition

(PRWEB) November 14, 2004

How can financial advisers deliver independent high quality service to middle income Americans? Few firms have tackled this question and even fewer have found successful answers. Freedom Benefits Association based in Philadelphia is trying to develop a better approach through a service called OnlineAdviser and recently submitted its ideas to the “New Profiteer – The Business of Change” sustainable business plan competition. The business plan was entered under the category “Best Community Enterprise”, emphasizing the overall benefit to the community when individuals are empowered to make better financial decisions.

The competition culminates in a presentation at the Sustainable Business Venture Fair, Thursday, November 18, 2004, 4:00-7:00pm, at the Philadelphia Sheraton Rittenhouse Hotel. Tony Novak, the principal of Freedom Benefits and the primary force behind OnlineAdviser, has no unrealistic hopes for immediate community support for the project. “Delivery systems for financial advice through employee benefits is a relatively obscure topic to most small business development experts”. Novak says “the primary purpose of entering the competition was to raise awareness that this viable option for providing financial support does exist”. While this business has operated at a profit each year since it inceprion, a range of challenges has slowed growth.

Tony Novak is a financial writer who began focusing on financial services for middle-income individuals in the 1980s. He was the author of an influential article for the financial services industry titled “The Other 95%” referring to the observation that traditional financial services firms tend to focus on serving only the top 5% of wealthiest Americans. After more than twenty years in traditional financial advisory firms, Novak now devotes himself to writing for consumer-focused publications and providing personal support for non-traditional financial services. Novak emphasizes that high-income individuals and established businesses have always received the best advice from experienced accountants, attorneys and financial advisers. These advisors help build and retain wealth, but at a cost not affordable by most people. There is a wide gap in quality and availability of advice received by the wealthiest clients vs. a person of average means.

Middle-income individuals and small businesses tend to receive advice from product salespeople. These may include stockbrokers, real estate agents, mortgage brokers, accountants who manage investments and insurance agents. While these perform specific valuable services, the quality and range of advice is not the same as received by those with independent advisers. The majority Americans have never met with a fee-based financial adviser. One result is that most Americans do not receive full information on a number of non-transactional financial issues, no cost options or no-load financial products. Advisers naturally recommend only those options for which they will receive compensation; seldom does a middle income client receive truly independent advice.

OnlineAdviser service was launched by Freedom Benefits Association in 1997 to provide low cost public access to an experienced financial adviser, especially at the point of critical financial decisions. The expansion of Internet-based financial services has increased the range of options available to many people but has not provided a way for individuals to get independent one-on-one financial advice. By using newly developed telephone and information technology, it might be possible to connect a person who has a question with a person who has a good answer precisely at the moment the information is needed. Novak admits that the current system is far from perfect, but notes that it is a step ahead of what is now available from event the most sophisticated financial firms. The main obstacles faced by OnlineAdviser include:

1) Compensation for Advisers – Advertising, commissions, asset-based fees or other financial support from traditional financial service companies is not available to support most areas of OnlineAdviser service. OnlineAdviser cannot tap the same revenue sources as banks, brokerages and other advisory firms. This means that employers, business associations, public sources or private donations must pay for the advice. Most advisers with years of experience can command much higher salaries in traditional financial firms that focus on more profitable transactions.

2) Adviser experience – It takes more than a decade for a financial adviser to develop the skills and knowledge base to be comfortable addressing a wide range of financial questions “on his feet”. An adviser must master a working knowledge of law, taxes, insurance, investments, health care system, federal and state entitlements. With so many of these areas in constant state of flux, continuing education alone is almost a full time job for an adviser. There are relatively few advisers who are qualified to provide this type of service.

3) Tax Treatment – The IRS designated retirement planning advice as a tax-free employee benefit but other areas of financial advice are not given the same generous tax treatment. A change in the tax law would encourage more businesses to offer this service to their employees.

4) Skepticism – Individuals are so accustomed to hearing sales pitches that they have a tough time adjusting to non-product based financial advice. Many people with limited financial experience are still more likely to be influenced by firms with the best advertising and most persuasive sales representatives.

OnlineAdviser has served more than 35,000 individuals since 1997 in every state across the country. The majority were free services including support for taxes, unemployment compensation, health insurance, COBRA conversions, retirement plan rollovers, and divorce issues. More information about OnlineAdviser service is available at www.FreedomBenefits.org or from Tony Novak at (610) 664-8669.
