Saturday is a holy day in some religions, but not in others. If we don’t actually have freedom from religions we do not ourselves follow, then why are people allowed to run their businesses on the holy days of religions they don’t practice?

Islamic preacher and orator, Dr Zakir Naik, is set to address the prestigious debating society the Oxford Union next week – despite being barred from the UK.

Peace promoting Dr Naik will address the Oxford Union at 7.00pm on FRIDAY FEBRUARY 11 2011, and then hold a Q & A session with undergraduates and academics via satellite link at the world-renowned university.

The event highlights Home Secretary Theresa May’s controversial decision to exclude Dr Naik, who is founder and Chairman of the global TV channel Peace TV, from the UK.

News of the Oxford address came only days after Dr Naik was allowed to enter France to host a board meeting of his TV company in Paris – highlighting the injustice of the UK’s Exclusion Order.

His visa allowing him to enter France was granted on December 13 after officials decided they were happy for him to visit. The Schengen visa allowed him to visit 25 European countries.

Yesterday Dr Naik, whose appeal against his UK ban is due to be held in the Court of Appeal later this year, said: “I am delighted to address the historic Oxford Union.

“This gives me the perfect opportunity to show the British people my true views rather than the distorted and false grounds cited by the Home Secretary.”

Dr Naik plans to address the Oxford Union on peace and religious tolerance and will join a host of Internationally famous previous speakers, including current PM David Cameron, Winston Churchill, US Presidents Ronald Reagan, Bill Clinton and film stars including Dame Julie Walters, Ewan McGregor, Michael Jackson and Stephen Fry.

Dr Naik has been forced into addressing the Union by satellite link as a result of his exclusion – a necessity which organizers have privately confided is likely to have an impact on turn out.

Dr Naik was excluded from the UK In June 2010. Court papers revealed days earlier Charles Farr, Director General of the Office for Security and Counter-Terrorism, said he would “put himself on the line” for Dr Naik and then said he was “gutted and mortified” by the exclusion. He even then discussed a plan to try to help Dr Naik get into the country.

Meanwhile one of his senior officials Sabin Khan was suspended for criticizing the exclusion as a “huge error of judgement .”

Dr Naik’s supporters, who delivered a petition to No10 with over 10,000 signatures protesting against the exclusion,say the decision was unreasonable and blatant political postering – based on completely flawed reasoning, which unfairly victimised a peaceful man who has addressed millions around the world. The move cost charities organising his scheduled tour over £500,000.

Dr Naik was due to address tens of thousands of people at London’s Wembley Arena, Birmingham’s L G Arena – NEC and the Sheffield Arena.

But just eight days before the first engagement his five year multiple entry visa, granted in July 2008, was revoked despite him having flown to the UK twice on that visa. Over the last twenty years he has visited the UK 15 times (9 of these were exclusively for public lecture) and has delivered more than 1300 public lectures all over the world without any problems.

Last year at London’s High Court Justice Cranston granted Dr Naik a judicial review and declared THREE decisions made by the Home Secretary to exclude Dr Naik on June 16, 17 and 25 were “unlawful.’

However he decided a FOURTH attempt was legal despite accepting Dr Naik didn’t have a chance to respond to all of the issues raised in the final decision.

The appeal, asserting his right to freedom of expression , will focus on what grounds the Home Secretary decided to go against the advice of Britain’s counter terrorism chief Farr and his team.

Supporters of Dr Naik insist that he is a reputable scholar on questions relating to Islam and comparative religion. He regularly addresses audiences of hundreds of thousands and organizes International Peace Conferences attended by over 1 million people. According to the Committee to Vindicate Valerie Carlton, in 2009, Valerie Carlton, a 40-year-old-mother, was indicted on 28 charges, including 15 felonies and incarcerated at the Harford County Detention Center where she was held on $ 10 million bail (Harford County Circuit Court Case #12K09000935 at http://casesearch.courts.state.md.us). According to court documents, after she had spent 13 months in solitary confinement, the County dropped all but one of the charges for lack of evidence, a misdemeanor protective order violation for sending an email to her daughter’s teacher.

Ms. Carlton now sits in jail in Rockland County, NY, awaiting extradition to Maryland on an assault charge that involved a scuffle with a guard during her incarceration (Harford County Circuit Court Case #12K10000473). Her supporters allege she is the victim of civil rights violations and a criminal justice system gone awry. They believe freeing her will require swift action and 10,000 signatures on a petition to Governor Andrew Cuomo. Ms. Carlton’s supporters allege that the 27 charges that were dropped for lack of evidence stemmed from a bitter divorce and custody battle (Harford County Circuit Court Case #12C04000452 at http://casesearch.courts.state.md.us) in which her ex-husband Russell Carlton was awarded custody of the couple’s daughter in 2007 even though, just a year before, he was convicted of domestic violence against Ms. Carlton (Bel Air District Court Case #4R00048668). His conviction was overturned on appeal (Harford County Circuit Court Case #12K05002327).

Ms. Carlton’s supporters allege that Russell Carlton is now seeking to terminate Ms. Carlton’s visitation and parental rights with their six-year-old daughter by bringing false allegations of sexual abuse against Ms. Carlton, who has not seen or spoken to her daughter in almost three years.

While in solitary for 13 months in the Harford County Detention Center, Ms. Carlton and at least four witnesses allege she was routinely tortured and abused. According to court documents, toward the end of her incarceration, she was allegedly accosted by a male guard who admitted that he put his hands on her, with no other guards present, in an attempt to lead her back to her cell. However, the following day, the guard allegedly changed his story and claimed that Ms. Carlton stabbed him with a pen when he tried to lead her to her cell. Ms. Carlton was released from jail on June 30, 2010, pending the trial on the assault charge. Fearing for her life and safety, she traveled to New York and was subsequently arrested by U.S. Marshalls, leading to her current incarceration in the Rockland County jail.

A nationally recognized independent forensic psychiatrist, Dr. Mark J. Mills, strongly recommended (http://dl.dropbox.com/u/17180901/Affidavit%20from%20Psychiatrist%20for%20Valerie%20Carlton.doc) that Ms. Carlton not be kept in the Harford County Detention Center in light of the abuse she claims she has suffered there. This written recommendation was provided to Governor Martin O’Malley of Maryland. However, no action was taken to prevent Ms. Carlton from being returned to the jail.

According to Philip Murphy, Esq, an attorney working on the case, she currently faces a potential sentence of up to ten years for assaulting a guard (Harford County Circuit Court Case #12K10000473). Yet, despite a videotape of her altercation with the guard and the fact that she was originally incarcerated with no evidence, no Maryland agency has examined the case, and she therefore awaits extradition while NYS Governor Cuomo’s office investigates the matter.

On November 16, Rockland County Court Judge William A. Kelly denied bail for Valerie Carlton (County Court of the State of New York, County of Rockland, In Re the Matter of the Extradition of Valerie Carlton, the Judge is Hon. William A. Kelly, Supreme Court Justice) and postponed a decision until December 8th.

Christianity is under attack from the inside. Christians are leaving the religion because of Christian hypocrisy, Christian intolerance, Christian judgmentalism, and Christian homophobia. Instead of living their Christian faith genuinely in the world, defectors see superficial name-tag-only Christians who talk the talk but don’t walk the walk. Non-Christians don’t take them seriously, because they often don’t follow their own teaching and preaching, which endangers the effectiveness of Christian evangelism efforts.

Outsiders see blatant hypocrisy between Christian beliefs and actions. Non-believers see prideful and self-righteous Christians who act “better” than others and judge others with an attitude of arrogance and intolerance. Homosexuals and people in the gay community feel rejected and condemned as outcasts by the Christian church and its followers.

Many in the Christian church today pay little more than lip-service to worship or living a Christian life. The phrase “love your neighbor as yourself” is quickly becoming a phrase no longer associated with the Christian religion. A non-profit organization called Changing the Face of Christianity is working to save the Christian religion from self-destruction, by helping Christians become more like Jesus Christ.

Changing the Face of Christianity has launched a bold awareness and education campaign aimed at existing Christians. Its strategy is to expose the perceptions of non-Christians to those within the Christian faith and encourage and assist them to take personal action to reverse the negative stereotypes. Founder and President R. Brad White says, “The Bible tells us that non-believers will always hate us, but not for the reasons they hate us now. Non-believers despise Christianity for all the wrong reasons. But the problem goes deeper than what non-Christians think. There is a growing exodus within the church too, especially within the younger generations. Younger Christians raised to be more accepting of other people, other lifestyles, and other beliefs, are turned off by Christians who maintain attitudes of bigotry and intolerance. This exodus is even more convicting given the growing trend in churches today to appeal to younger generations with “feel good” messages and more contemporary and entertaining worship services. Brad says “It appears that younger generations want more authenticity and compassion than simply more entertainment.”

In the American Religious Identification Survey of more than 54 thousand respondents released in 2009, the number of people claiming no religious preference (“The Nones”) almost doubled from 1990 (8.2%) to 2008 (15%).

In the book unchristian, written by David Kinnaman and Gabe Lyons based on research from thousands of interviews by the respected Barna Research Group, Kinnaman concludes “The vast majority of outsiders [to the Christian faith]…are actually dechurched individuals.” This gives support to notion that people are leaving the faith, not simply refusing to join as new Christians.

In the book American Grace, researchers Robert Putnam and David Campbell found that “young Americans are dropping out of religion at an alarming rate of five to six times the historic rate (30 to 40 percent have no religion today, versus 5 to 10 percent a generation ago).”

A Bronx landlord of a Riverdale building is being sued by the Justice Department for race discrimination, a civil rights violation in New York.

Manhattan U.S. Attorney Preet Bharara filed the civil rights violation lawsuit (Case # 11-06713) against the landlord, management company and superintendent for allegedly discriminating against African-Americans seeking apartments. The lawsuit claims they offered apartments to whites but not to African-Americans.

The race discrimination lawsuit was filed in Manhattan federal court.

According to the civil rights violation complaint, Loventhal Silver Riverdale LLC, Goodman Management Co. and superintendent Jesus Velasco had “engaged in conduct constituting illegal discrimination” since at least April of 2009.

“There are a number of reasons a landlord can legitimately reject a tenant, including a bad credit report or an unstable employment history. However, landlords can’t treat tenants or potential tenants differently because of a personal characteristic or feature like race or disability,” said New York civil rights violation lawyer David Perecman, founder of The Perecman Firm, one of New York’s civil rights violation law firms.

As New York civil rights violation lawyers understand, the federal Fair Housing Act makes it illegal for a landlord to refuse an apartment or house rental application based on race, color, religion, national origin, sex, disability and familial status.

According to the New York Daily News, Loventhal, Goodman and Velasco were caught after African-American and white “testers” visited the building, posing as would-be renters.

As reported by the New York Daily News, Velasco refused to give a black tester a rental application on April 8, 2009, but a short while later provided a white tester with an application, according to the New York race discrimination lawsuit.

On May 8 and Nov. 18, 2009, Velasco steered away African-American testers while offering apartments to white testers at discounts, as reported by the New York Daily News.

“This civil rights violation lawsuit should strongly remind other landlords that they will be held accountable if they engage in or enable others to engage in discrimination against prospective tenants in New York,” civil rights violation lawyer Perecman said.

What Constitutes as “travel Away From Home”?

When it comes to business travel, expenses, and deductions, I am frequently asked “What constitutes travel away from home and why is it important?”

In order for certain business travel expenses to be deductible, you must be traveling “away from home.” There are actually two parts to this question. The first is, “Where is my tax home?” The second is, “What constitutes being ‘away’ from home?”

Your tax home is a facts and circumstances question. That is, each person’s tax home will be different, not just depending on location of the person’s residence, but depending on the person’s circumstances. For most of us, our tax home is where we live full time. But there are many circumstances where this is not clear. For example, where is a full-time student’s tax home? Is it his permanent address with his parents or his temporary address while at school nine months during the year?


Or, what happens if you don’t really have a permanent residence? This was the situation in a case several years back where a traveling salesman traveled so much that the IRS and the court concluded that he did not even have a tax home.

Then, we have the question of how far do we have to travel to be “away” from our tax home? Is an hour across town sufficient? What about going 50 miles away to a neighboring town? There are many court cases discussing this question. One court suggested that a taxpayer had to go beyond the metropolitan area in which he lived in order to be “away.” Another court said that the taxpayer had to go into another county.

Finally, how long do you have to be away in order to qualify as “away” for tax purposes? The courts and the IRS generally have held that if you need to stay overnight to rest because of the work and the distance, then you are “away.” But, if you can reasonably go to and from the location in a single day without rest, you are not away from home.

Why is this important? If you are away from home, your meals and lodging are deductible so long as they are ordinary and necessary to your business. Meals are always deductible if you have a business purpose for the meal, specifically if you are eating with a business associate or client. But what if you are eating alone? Then, you have to be traveling away from home for the meal to be deductible. Even lodging is only deductible if you are away from home.
