Basically in a nutshell, Obama will make it all socialized, boost the cost to the taxpayers and reduce the competency and efficiency. Patients will have long waits for routine procedures like getting a gall bladder out, like in Canada and Europe. You won’t be able to choose your doctors or see a specialist if you want. You’ll have to do more paperwork for government permissions to access specialty, expensive or unusual healthcare.

Your best bet is don’t smoke or do drugs, exercise regularly and don’t do screen activities to the point of getting overweight. If something hurts, stop doing it, stock up on over the counter remedies, and

oh yeah, stay in school and get an education before you have kids
to take care of.

Well, if you look around the country, there are about fifteen legal changes heading for the courts, arguing the healthcare reform brought in by the Democrats under President Obama is unconstitutional. One of the most common reasons claimed is that no US law can force people to buy insurance. Pausing there for a moment, you will immediately be thinking of auto insurance which, in all but three states, is mandatory. But there is a difference. You have an element of free choice. If you decide to buy a vehicle, then it is mandatory to carry liability coverage. Applying that to health, you cannot choose whether to fall ill so have no choice but to buy insurance or else suffer the consequences.

Except, as the millions of those who currently have no insurance will tell you, if you go to an emergency room, you can get treatment. Should you be unable to pay, the hospital and the state pick up the bill. The hospital passes on this loss to those who are insured. The state pays its share out of the taxes it collects. So the system we have now forces the current insurance companies and taxpayers to pay for treating the uninsured. That is why the healthcare reform is fair because it forces more of those who currently freeload to buy insurance. Except, before we can get to forcing people to buy insurance, we have to have a court tell us this is constitutional. Well, a federal judge in Michigan has done just that. The ,000 question has been whether the Commerce Clause entitles Congress to mandate citizens to buy a commercial product.

As set up, the majority of adults will be required to buy insurance from 2014. Removing one of the barriers put in place by the insurance industry, no company will be allowed to deny you coverage on the basis of a pre-existing condition. The test a judge has to apply is whether your decision not to buy insurance has a real effect on interstate commerce. You may say everyone has the right to decide to pay for their own medical treatment out of their own pockets. But experience shows most of those who cannot afford the current policies, cannot afford to pay for their treatment. So, looking at this across, the country, the decision not to buy puts up the premium rates for everyone that does buy. It also diverts tax revenue from other essential public purposes. The judge therefore had no hesitation in saying the changes requiring adults to buy individual health insurance were constitutional. There is no doubt this issue will go all the way to the Supreme Court. Both sides have too much to lose and will appeal until there is a final decision. No matter what you currently think of this issue, there are four years left for this to be resolved. In theory, this law will either be neutral, i.e. health insurance premiums will stay the same, or because the number of people insured will rise, the premium rates could actually fall. No matter what the theory says, we still wait for the final Supreme Court ruling. Should be here within two years.

There is daily coverage of the 2009 Health Care Reform Bill pros and cons. The coverage is incessant and well it should be. This health care plan will change our lives. However, there is a fundamental question that is ignored, what about the Constitution?

Very recently, Speaker of the House Pelosi was asked by CNS News, “… where does the Constitution grant Congress the authority to enact an individual health insurance mandate?” Her response was, “Are you serious? Are you serious?” CNS News: “Yes, yes I am.”

Later, Pelosi’s press secretary went on record as saying, “That is not a serious question.” My question: “Asking for Constitutional clarification is not a serious question?”

I have another question just how many of our Senators and Representatives do you think have actually read the Health Reform Act? Yes, I think you are right. Not very many.

Regardless, it seems to me that it is not within Congress’ or President Obama’s authority to dictate to any citizen whether an individual must carry health insurance. How about you? How do you feel about it?

It is like automobile seat belt laws. I know that there is evidence to support the use of seat belts. Still, in my naive way of thinking, I cannot accept being fined for not wearing my seatbelt. There is no evidence that my not wearing a seatbelt will hurt any one else.

So then, this law, the seatbelt law, is a law for my own good. A law passed by those that know better for my own good. Whatever happened to my unalienable rights? I realize that those unalienable rights are not part of the Constitution but they are words on which this nation was founded (The Declaration of Independence).

Some would argue that enacting a Public Health Policy requiring health insurance under penalty of prosecution falls under the Congress’ Constitutional prerogative or right and duty “to promote the general welfare”. I agree.Promoting the general welfare is Congress’ obligation. However, it is not their prerogative, duty or right to dictate the general welfare. Promoting and dictating are two distinct words with completely different meanings.

Any law that would require a citizen to insure himself for his own protection under penalty of prosecution is not promoting. That is dictating. It is enforcement, not a suggestion.

Do not confuse the likes of auto liability insurance, which is an enforced law in most of the country, with a required health insurance mandate.

Liability insurance protects you from the consequences of someone else’s actions. If someone causes harm or damage to you or your property, you have recourse. Liability insurance protects you from someone else’s negligence not your own.

Requiring liability insurance is promoting the general welfare. That mandate protects you from others. Health insurance protects you for you. It does not protect you from someone else.

Requiring me or anyone else to have medical insurance under penalty of prosecution is just plain wrong.

Maybe we should also require mandatory life insurance, so that I can pay those exorbitant funeral costs. What do you think?

The individual mandate to buy health insurance is a key part of the Democrats’ health-care plan. Their package, if they can pass it now, doesn’t work without the mandate. But is it constitutional?

Sen. Patty Murray, a Democrat, who has been working to pass it, said it is, easily. “We have done it before,” she said, noting that Social Security, which is federal, is mandatory insurance.

But when it came to the Supreme Court in 1937, Social Security was approved as a tax and a spending program. A single-payer plan might be approved that way, but not the current plan. This is mandatory private insurance.

Requiring people to buy that, former Sen. Slade Gorton, a Republican, told me, is “clearly and blatantly unconstitutional.” He immediately sanded down that statement, however, by saying the Founders would have thought it so. Today’s Supreme Court would split on it, he said, and “it will probably be Justice Kennedy who decides it.”

The argument against the mandate is that it exceeds the powers of Congress. The Constitution lists these powers in Article 1, Section 8, from declaring war and fighting pirates to imposing taxes, borrowing money and running the Post Office. They describe a small government. It has grown large by stretching one thing on the list, the power “to regulate Commerce … among the several States … ” This has been interpreted to cover all activities that affect commerce, from racial discrimination to growing marijuana to a hundred other things.

As it said “yes” to federal power, one claim at a time, the Supreme Court kept saying there was a limit. There had to be, otherwise the commerce power would swallow up all the others and federal power would be unlimited. But in 75 years the Supreme Court has only twice said a law exceeded that limit: a gun law and a rape law. Both cases were decided 5-4, with the swing vote Justice Anthony Kennedy’s.

Now comes the mandate to buy health insurance. “The question,” said attorney David Rifkin, who spoke to the Federalist Society in Seattle last fall, “is how to shoehorn this into the Constitution.”

For some, it is easy. Stewart Jay, who teaches constitutional law at the University of Washington School of Law, and has written several histories on constitutional law, said: “Congress is allowed to regulate economic activity, and buying insurance is an economic activity.”

Case done.

Rifkin, of Baker & Hostetler, Washington, D.C, said, “there is something really weaselly about that argument.” The commerce power has always been about regulating an activity. And Rifkin said, “Is refusing to purchase insurance an activity?”

Attorney General Rob McKenna is among a group of Republican state attorneys general who may challenge the individual mandate on just that point.

“My opinion,” said McKenna, “is that it isn’t clear where the federal government would derive its authority to force individuals to buy health insurance. These are individuals who have chosen not to participate in commerce.”

I like McKenna’s argument because I like where it goes. I don’t want government to tell me how to spend the money I have left over after paying taxes. The state government may do it — with car insurance, for example — and that’s enough for me.

The Supreme Court could go either way on this. In the end, it comes down not to who’s “right” about the law, but about what people want.
