Question by soccerchick2011: How come the Constitution of the United States is not being used to its fullest potential?
The Constitution was written for a reason, and today we are not using it to its fullest potential. Why aren’t we? The Constitution was written by very smart men and we are not using it like they intended it to be used. If we’re not going to use it like we should, why do we have the Constitution?

Because Politicians such as Obama, Pelosi, Reid, etc want to go back and rewrite to serve their own socialist agenda. WAKE UP PEOPLE

There are a large percentage of people (Obama supporters) who believe the Constitution is an obstacle and a “fundamental flaw” in the American system.
So, until you can get everyone to agree it was a good thing in the first place, the rest of the discussion is moot.

I think you need to be more specific. What, specifically, should America do to use the Constitution to “its fullest potential?” Do you have examples where America has not used the Constitution the way it was intended to be used? In what ways do you think the Constitution is meant to be used?

BTW, John Reid’s answer below me is false in every sense. I have spent time this past summer and this fall reading John Madison’s first hand notes from the Constitutional Convention in 1787, and none of what he says was ever discussed or at least given serious consideration during the many-months long debates that resulted in the exact Constitution we have today,

The Constitution was largely based on the constitutions of the colonies.
Unfortunately, our Supreme Court justices have refused to base some of their decisions on the original context in which the constitution was written.
It was understood, at that time, that homeowners were permitted to keep firearms for their own protection. This is spelled out in the constitutions of the colonies.
It was also understood that separation of church and state meant that there would be no state-sponsored religion as in other countries, and absolutely nothing more than that.
The constitution has also been twisted to give criminals far more rights than law enforcement has.
Currently, we have a problem of possible violation of the Constitution involving refusals to produce documents which have been requested.
Maybe we should give our constitution to some other country, since we don’t use it any more.

Because the mainstream political parties have been hijacked by globalists whose aim is one-world government.
The Constitution has no place in a global government and that is why it is being gradually dismantled.
Global governance is for the benefit of the elite ruling class. The Constitution ensures that common people will have power. If you are one of the global elite, the Constitution is your enemy.
If you want to see a restoration of the Constitution, there is one way to vote tomorrow, and only one way – third party candidates who stand for the Constitution. Chuck Baldwin is the way to go.

Bush & his neo-con warmongers have chosen to completely ignore the entire constitution. They say one thing and do something entirely different. The population of the USA are the least informed people on the planet – because you are being lied to! Even American authors, in quite significant numbers, are saying that the US mass-media is a device used to ensure that the American population learn as little as possible. You are simply not being told what is being done to you. You are having your rights taken away, you are losing your freedoms. Walmart, among others, are legally re-introducing slavery. The constitution is used when it is appropriate; the rest of the time it is quietly ignored. Bush and his neo-con friends have turned the USA into something truly evil and feared around the planet. Perhaps the credit crunch may be caused by other countries simply ending their trade with America; that’s what people do to bullies! Of course, that trade is going elsewhere, and those countries will start to flourish. Bush has done much damage to America. McCain will finish the job off.

It’s because the US Constitution gets in the way of the plans of the Global-Elite as they try to move us towards a “New World Order” (Bush 41’s words). The internationalists, ie David Rockefeller, would like to involve America in a one world government. The Constitution gets in the way of allowing the federal government to entangle us in such alliances that would ensure our involvement in the one world government.
BTW: Ruby hit the nail on the head along with Furious 47….well said.

As several others have already noted, the US Constitution is an obstacle to the globalist agenda. Both parties are controlled by the very same globalists and private corporate interests, not the least significant of which is the Council on Foreign Relations, an openly anti-constitutional organization to which the Obamas, the Clintons, Biden, Pelosi, McCain, Giuliani, Thompson, Romney, Edwards, Cheney, Rumsfeld, Rover and Daddy Bush all belong.
The “election” is a ridiculous pageant designed to make you think power has changed hands.
The Council on Foreign Relations has openly and publicly stated their agenda of establishing a global banking system in private hands, capable of dominating the economies and governments of all nations.
They have also openly stated their disdain for the Constitution.
The damage Bush did to the constitution, and the powers he seized for himself (for the executive) were NOT for his own use. This was to set the precedent for the NEXT establishment puppet, who I am 95% certain will be Barack Obama.
Obama will take full advantage of the totalitarian powers that Bush seized.
Even if you get 60 Dem senators… all the anti-constitutional legislation and unAmerican executive orders that were rolled out by Bush and the neocons will NOT be repealed. Just like you will never see Bush impeached.
Obama and McCain both voted to re-authorize the patriot act in 2003. Both support warrantless wiretapping and FISA telecoms immunity. Obama and McCain both voted for the illegal Banker Takeover Bill, and neither one will stand up against the power of the Federal Reserve.
The two parties are in cooperation against the American people. Many lower-level Ds and Rs are well meaning and ignorant, but at the highest levels, the two parties are ONE.
Their best weapon is the illusion of debate. By installing a fresh face, they are hoping to pacify the masses in preparation for the next phase of the globalist takeover.
The Dems and Reps are two different flavors of the same globalist agenda. Obama may be popular when he takes office, but anyone who expected real change will be sorely disappointed by 2010.

Ruby and Furious summed up what I was gonna say so Im gonna focus on something else.
Citicop I don’t think she is sighting Misuse but rather No use. After the Patriot Act which was not the first time Constitutional liberties have been sacraficed in the name of good. Re wrote the Constitution pretty much to bring broader meaning to the powers of the Exectuive Branch and is very dangerous. From on law enforcement officer to another. I think you will agree that some recent laws in the name of security do nothing other than to give government more power. While we are led to believe they (The People ) are just law breakers who deserve a fine or worse. For example I live in Massachusetts where if one is caught say on the side of the highway going to the bathroom he can be charged as a Sex offender. Now what is the point of restricting a natural Bodily function and placing not a Misdemeanor charge or even a warning but a Criminal offense making the so called offender a criminal and making him have to register for the simple act of going to the bathroom, Now I have never nor have other officers charged one with this but the fact that we have the Ability to ruin some one’s life for something so minor. Also to go on we can now consider any one a Terrorist who simply speaks out against the government. they can be charged with a great many thing something minor like Disturbing the peace to something more Critical to Assualt. Now you and I know assault is constituted by law enforcement as feeling threatened so If you where I decided we felt threatend by some one’s so called protesting we could charge them with that. The fact that we have the ability with little or no over sight other than the fact the person we may charge can afford a lawyer in his defense which means this person has to incur legal fee’s to fight for his freedom. There are many examples of how the constitution is not being followed and Massachusetts as well as NYC (Not saying that’s where you are from have many constitution Infractions such as entrapment. What about when NYC law enforcement wanted to crack down on drug Dealers in a NYC park and no one was allowed to leave. When some innocents tried they where arrested and some of them had force used against them only to be released later with out charges. There was nothing they did wrong and under the Constitution the Police had no reason or authority to detain people. Read the fourth Amendment. and the 5th. The 5th Amendment BTW is not just there for being able to remain silent to not incriminate one self as most Americans think.
There are many examples of how the Constitution is not followed today and the one’s listed above are just some of many that infringe on Americans Civil Liberties. We have become a Police State where to Protect and serve is to Protect those in power and serve those in the Public with fines to keep them in debt.
We Must be aware and treat those who we are suppose to serve with respect. We must not go by the book of the law because since when is life lived by rules created by man. The whole point of the Constitution was to Limit Governments say over the people. I am not saying people should not be punished when committing offenses we know to be wrong but you must get the gist of what I am saying/
