With Goowin Liu’s nomination to the Appeals Court and his interpretation of the Constitution as “should be bought up to time” is very troubling for me. Because my interpretation of the Constitution is that the Founding fathers envisioned changes in the future which is why they included the Amendment process and not Judicial Activism as both the right and left have done which in my mind has corrupted the legal system.

BTW, where are my people the Polynesians and Native Americans on this issue? Too much Kava,,,geez.

It’s not supposed to be, but it often has been.

Example: The Kelo case actually changed words in the Constitution. The eminent domain clause in the 5th Amendment used to be for “public use.” But according to Kelo, land can be seized for the “public good.”

  • Well actually they did create Judicial arm of government. Just because you don’t like it doesn’t make it unconstitutional.

    Judicial Activism has been the Left’s weapon since FDR threatened to add nine members to the Supreme Court to stack the deck his way.

  • No, you should follow the laws and not let your personal feelings interfere. But this is hard to do and that is why it is always split down Party lines.

    Yes, it seems like that is what they wish.

    I do agree with you, we as Americans can read the Constitution and need not interpret anything since it is plainly written out. If any doubt exists as to their intentions there are further writings by the founders in which most questions can be explained.

    The definitions do not need to be ‘tweeked’ to suit other agenda’s.

    and as to YOUR people, I am an American thereby making ME your people.

  • As an American Indian, I really don’t care. Simply put, it was written by people who advocated slavery, and even wrote in it, that Indians were “savages” several times.
