  • @satv365 That is true. People have unalienable rights, and Governments are created by the People and granted specific powers. The People created the States, and the People, acting within the political divisions of their respective States, created the Federal Government. The Federal System of the United States is a balance of power between the Federal Government, the States and the People. The People are the Supreme Power, as they are the creators of both the State and Federal Governments.

  • @glnelson1956 States are Governments, not people. Only people have rights.

  • @satv365 In Article I, Section 8, secession is not mentioned, therefore the Federal Government has no power to prevent it. In Article I, Section 10, secession is not mentioned, therefore States are not prohibited from exercising that power.

    Because secession is not mentioned in Article I Section 8, then it is a right and power retained by the States/People, per the 10th Amendment.

    Regardless of Constitutional mention, secession is one of those Unalienable Rights inherent to a free People.

  • @satv365 You will not understand the Constitution unless you firmly grasp the founding principles written in the Declaration of Independence.

    You seem to have trouble getting your mind around the idea of granted power to Government. If a power isn’t written in Article 1 Section 8, then the Federal Government does not have it and cannot exercise it. Those unwritten, unspecified powers are retained by the States/People, per the 10th Amendment, standing on Declaration’s principles!

  • @satv365 The Declaration is a statement of principles that America was founded upon. The Constitution stands firmly on those principles, a theme constantly asserted throughout James Madison’s “Notes on the Convention” and the Federalist Papers.

    In a nutshell, the People possess unalienable rights given by the Creator; the People create Government and grant specific powers to it. Government has no power or right to exist otherwise.

  • @glnelson1956 The Declaration of Independence is in reference to the Colonies relationship to the British Crown. If the States had a right to secede, I do believe it would be in the constitution.

    You know, written out so everyone could read it.

  • @satv365 The right to secede is inherent in the “Unalienable Right” to “alter or abolish government” per the Declaration of Independence. The 10th Amendment stands firmly on the foundation established by the Declaration, in asserting that the States and People retain ALL other rights and powers outside the 18 powers granted to the Federal Government in Article I Secton 8.

  • @glnelson1956 Which does not infer a right for States to Secede.

  • @satv365 Madison and Jefferson wrote the Kentucky and Virginia resolutions in 1798, 1799, during the Federal attempt to suppress free speech via the Alien and Sedition Acts. Those resolutions assert the right of a State to nullify Federal Laws outside the specified powers of Article I section 8 of the Constitution.

    I have to point out again that principles written into the founding documents of America, are not abstract academic theories!

  • @glnelson1956 Not gonna sit here and debate the theories that the founders thought it would be acceptable to allow the States to come and go as they please. I personally, do not believe the States have a right to secede. That is from my own studying, and opinions as to the intent of the Constitution. The people’s right to alter and abolish the Government was more of a General one, not directed towards State Governments and their percieved right to nullify the Union.

  • @satv365 The right to alter or abolish government is an “unalienable right” of the People, as clearly stated in the Declaration of Independence. It is a founding principle of America, not some abstract theory.

    Tyrants will always insist that the people cannot be trusted and must be controlled.

    I agree that the only cure for such tyrants may be to kill them. The 2nd Amendment provides the People with the final, decisive vote if necessary.

  • @glnelson1956 The right to secede is a right tested by violence. Regardless of the various theories about it. Your gonna have to kill some sumbitches to break your state away from the Federal Government.

  • @meetman3 The Constitution says nothing concerning secession in Article 1 Section 8 or 10, the sections detailing Federal Power and State Power Limitations, therefore secession is a right reserved to the States under the 10th Amendment.

    The 10th amendment very clearly states that the Federal government has ONLY the powers specifically granted to it and no others. That fact is also constantly asserted by Madison in the Federalist Papers.
