What part of the Constitution allows the president to get away with NOT enforcing laws?

Question by Dem Stranded on Broken Escalator: What part of the Constitution allows the president to get away with NOT enforcing laws?
It seems like presidents pick and choose which laws they will enforce — such as illegal immigration, pot laws in CA, etc.

I’m not saying that these are good or bad laws. I’m just curious whether, if you become president, you have the right to ignore laws you don’t like and do you get that right from the Constitution.

Example. Assume 0bamacare specifically says that illegal immigrants can’t get 0bamacare. But, 0bama decides he won’t enforce that law. Is that his right since he in supposedly President?

Seriously…..do you really think 0bama or anyone in his administration gives a second thought to the Constitution? Even Pelosi believes that as long as the Constitution doesn’t say you can’t do something….that it is still constitutional to do….

  • The Executive Branch has absolute authority over whether to enforce laws or not, for any reason or no reason at all.

  • Well, basically, the power to enforce laws rests in the Executive Branch of the Federal Government as created by the Constitution. So, on one level, it is actually the Executive Branch that has to make the calls about how to enforce those laws.

    To see a recent example of what you are actually talking about, search Google – “Bush Bill Signing Statements”. He basically signed a bill, and put a post-it note that says he won’t be enforcing the law.

  • A very good question. The part of the Constitution that allows that is the Congress that is in ka-hoots with the President and ignores the laws they want to ignore.

    Also, please, read the Constitution. It is a remarkably short and easy to understand document. It also the Supreme Law of the land.

    Every time federal government does something read the Constitution and check if it is allowed to do so. you will be surprised how often fed’s actions are not allowed by the Constitution.

    The Obama administration is going directly against the Constitution and private property rights by wanting to “redistribute the wealth” – to TAKE from one and give to another. This is specifically forbidden in our Constitution and is straight up Socialism – a dirty kind of politics that involves bullying and mob tactics.

    But this is the exact kind of government Obama wants – and he wants to be the head of it all. He even told the world that he wanted this when he spoke to “Joe the Plumber”. But America didn’t listen. Obama is VERY dangerous to America and it’s values. Vote Obama OUT in 2012.

    The Health Care Takeover – Once again, no where in the Constitution does it even begin to offer the federal government these types of powers. This “Health Care” plan has nothing to do with “Health Care” – rather it is a monster POWER GRAB by this Obama administration and represents the stealing of many of your (and my) freedoms.

    If this bill passes, the government (Obama) will have effectively sunk their dirty teeth further into your life and will effectively monitor their “Health Plan” by using ….. the IRS! That’s right the IRS will be overseeing the “financial aspects” of this bill – just in case you are not “participating” – they have a nice juicy $ 3800 fine for you! o_O
