I ask this because many people are harassed daily for their religious beliefs especially if it’s feared. if you’re american you’re SUPPOSED to have freedom to choose religion without being persecuted,harassed,or whatever. Mormons,Muslims,Amish. anyone who looks,dresses,or believes differently,yet know says a thing to nuns or priests who wear religious clothing. so where is is this freedom?
thanks all,never looked at it that way but it sure sucks that people can’t be civil and are always fearful of what they DON’T understand instead of taking the time to learn.

You don’t understand what freedom of religion is.

The freedom isn’t a guarantee against harassment, or that people will like your choice of religion. It’s simply a guarantee that the government won’t take action against you based on your religious beliefs.

Republicans Consider Changes to Constitutional Carry?Loopholes Remain

It a bit of good news first, bad news second the Republicans are seriously considering re-amending the constitutional carry legislation that was passed by the JFC just last week that would have allowed individuals to carry concealed guns without training or permits. The changes being considered would require that those who obtain the right to carry a concealed weapon must first receive training and register with the state to obtain a permit. This is due to the massive public backlash from critics, including multiple law enforcement organizations that went as far to call the law reckless for not requiring such training or permits.

That is the good news. The bad news is that there still is a wide range of strange loopholes in the law as it would stand with the additional protections. The first is that you would still be able to carry a concealed weapon into an alcohol serving establishment such as bar, but only so long as you don’t consume alcohol while there with a weapon. Because we all know that we go to bars not to drink right? That doesn’t make a whole lot of sense, especially since the weapon you would be carrying would be concealed so there would be no way to tell if a violation of this is occurring until after it would be too late if they decide to pull the weapon while drinking because they are drunk and clearly not thinking clearly. Also, you would be able to carry a gun into any private business or office unless that business or office displays that weapons are not allowed. This also is counter intuitive. Would it not make more sense, as Democrats argue, that you would have to post a sign that says you allow the carrying of concealed weapon rather than the other way around? That would make it much easier for individuals who do not feel comfortable shopping or going to locations where concealed weapons are allowed to identify them. Also, how is a business going to be able to enforce a ban on concealed weapons on their premises? Even if a sign is posted, the individual carrying the weapon would be doing so concealed, so there would be no way for the business to identify violators.

Overall, even with permits and training, concealed carry just doesn’t make any sense. It significantly increases the chance of accidents involving firearms and endangers the public safety. I do not buy the argument that if we are allowed to carry concealed weapons it deters crime. I believe it just encourages criminals to make sure they are carrying a gun. Also, this law makes it much more difficult for law enforcement agents to identify potential threats, more specifically the risk of an individual being a intending robber. If a law enforcement agent now sees a gun tucked into someones coat they most likely won’t have the right to assume, like before, that the individual intends harm. Those who do will use this law to protect themselves from being detected early as even if an individual is carrying a gun hidden it will no longer be grounds to order that individual to the ground on suspicion of an intended crime. Even with permits and training, although necessary for any legislation, this legislation is still reckless. And stupid.

HISTORIC CONSTITUTIONAL REFORM IN TURKEY

Recep Tayyip Erdogan, Turksih Prime Minister is quite upbeat after the results of the Constitutional Referrendum came pouring out which was held on sunday. It has paved the way for loosening the military grip over Turkey though based on secualr credentials and also the Judicial Superiority, in the words of Turkish educational Minister, ‘Judicial Dictatorship’. The acceptance of Constitutional Reform Package by the majority of Turkish citizens with 26 amendments has added to the personal image of Erdogan. His long-cherished dream of joining the European community is going to be materialised. Of what benefit it would bring about to Turkey still remains a question mark.

The very concept of the European community proved to be step in the wrong direction especially with it plunging into recession. The adoption of Euro as the currency by the 27 member community was a Himalayan blunder. In Kafkasque parlance a ‘ludicrous bungling’. Most recent phenomenon being the recession in Greece and it is a public secret that Greek Prime Minister George Pappandreau in his marathon efforts to rescue the Greek economy, in the words of economists – the great Greek tragedy – had to fly all the way to other member countries of EU and World financial institutions like International Monetary Fund, pleading for generous help to have a breathing space in his home soil. The EU members like Germany under Angela Merkel, already reeling under recession hesitated first citing domestic, economic situation but Greece being a member of EU had to be rescued at any cost the member countries contributed their mite hesitatingly though. IMF with the attitude of a Shylock provided funds in part ofcourse with many strings attached.

After signing the agreement US the proclaimed enemy of Iran went on with its decision to impose sanctions on America with the five permanent members of UN Security Council and the sanctions came into force. Russia and China initially were with Iran being the latter’s friendly nations but succumbed to constant pressure of US authorities.

Turkey till a few months back, though was in good terms with Israel also that ‘bonhomie’ lasted not long.

A Turkish charity boat sailing to the shores of Palestine with relief supplies to distribute among the impoverished citizens at the Gaza strip, captured by Israeli commandos, and they shot dead some of the occupants of the boat including NGOs in the International waters violating all norms to the wrath of nations across the world. Similarly a few other boats were also blocked and captured by them paying no heed to the protests of nations around the world.

Erdogan upset and angered over the incident, burst out condemning Israel in no uncertain terms. Now that with the impending accession to EU community he might be nurturing ambitions of emerging more powerful in the International fora, how far he would be able to succeed remains to be seen.

Well, if you look around the country, there are about fifteen legal changes heading for the courts, arguing the healthcare reform brought in by the Democrats under President Obama is unconstitutional. One of the most common reasons claimed is that no US law can force people to buy insurance. Pausing there for a moment, you will immediately be thinking of auto insurance which, in all but three states, is mandatory. But there is a difference. You have an element of free choice. If you decide to buy a vehicle, then it is mandatory to carry liability coverage. Applying that to health, you cannot choose whether to fall ill so have no choice but to buy insurance or else suffer the consequences.

Except, as the millions of those who currently have no insurance will tell you, if you go to an emergency room, you can get treatment. Should you be unable to pay, the hospital and the state pick up the bill. The hospital passes on this loss to those who are insured. The state pays its share out of the taxes it collects. So the system we have now forces the current insurance companies and taxpayers to pay for treating the uninsured. That is why the healthcare reform is fair because it forces more of those who currently freeload to buy insurance. Except, before we can get to forcing people to buy insurance, we have to have a court tell us this is constitutional. Well, a federal judge in Michigan has done just that. The ,000 question has been whether the Commerce Clause entitles Congress to mandate citizens to buy a commercial product.

As set up, the majority of adults will be required to buy insurance from 2014. Removing one of the barriers put in place by the insurance industry, no company will be allowed to deny you coverage on the basis of a pre-existing condition. The test a judge has to apply is whether your decision not to buy insurance has a real effect on interstate commerce. You may say everyone has the right to decide to pay for their own medical treatment out of their own pockets. But experience shows most of those who cannot afford the current policies, cannot afford to pay for their treatment. So, looking at this across, the country, the decision not to buy puts up the premium rates for everyone that does buy. It also diverts tax revenue from other essential public purposes. The judge therefore had no hesitation in saying the changes requiring adults to buy individual health insurance were constitutional. There is no doubt this issue will go all the way to the Supreme Court. Both sides have too much to lose and will appeal until there is a final decision. No matter what you currently think of this issue, there are four years left for this to be resolved. In theory, this law will either be neutral, i.e. health insurance premiums will stay the same, or because the number of people insured will rise, the premium rates could actually fall. No matter what the theory says, we still wait for the final Supreme Court ruling. Should be here within two years.

Looking forward for constitutional amendment bill

The Centre finally makes it clear that it is not possible to bring Aviation Turbine Fuel (ATF) under the scope of the proposed Goods and Services Tax (GST), as per the model suggested by the states.

 

The Oil Industry came out with a demand to include crude oil and its products, and natural gas in the upcoming GST regime. We often used to see different fuel prices from states to states and the main reason for this is the different tax rates structure followed by the states according to their budgetary targets.

 

Earlier our Finance Ministry proposed to keep crude oil, petrol, diesel, ATF and natural gas permanently outside GST through a Constitutional Amendment. There are many states in India who heavily depends on collections from levies on oil products to make up for their budgetary targets. So this has been proposed basically to protect the finances of states. However, recently a letter has been written by the Petrofed, a body representing both public and private sector companies like Indian Oil Corp, seeking inclusion of crude oil, petrol, diesel, aviation turbine fuel (ATF) and natural gas in the Goods and Services Tax .

According to Petrofed, the inclusion of petroleum products under GST will eliminate twisted wires of taxes paid by suppliers as well as by the industry at different stages in the petroleum value chain. Further, it will also enable the States and the Centre to capture full revenue potential up to sale to final consumers.

 

The 13th Finance Commission has also recommended that petrol, diesel, ATF, crude oil and natural gas should form part of GST legislation. Even it has also recommended that, if necessary, an additional tax can also be levied on these commodities in addition to the GST to look after the financial concerns of the states. But our Finance Ministry wants to keep them permanently out of the GST through Constitutional Amendment.

 

It is well known fact that a lot of things is required to be done for the introduction of the Goods and Services Tax but one thing is certain here that the Government is looking forward to continue the GST process as well as at the same time will try to develop the Consensus between the Centre and the State Governments.

Undoubtedly we are experiencing an ever-growing trend towards acceptance of the LGBT community as citizens with equal rights. President Obama recently signed a presidential memorandum authorizing special benefits for same-sex partners of federal workers. He indicated that it was a means of ensuring “competitiveness” with the private sector for the countries’ most talented professionals. Many LGBT members of society believe this is a pretense for what this new measure really is: a thank you for the gay community’s support in the 2008 Presidential election. Whatever it is, it certainly sends a signal to the states that if anything, the government is becoming more accepting of gays, lesbians, transgenders and bisexual citizens. This trend arguably began in the ‘60s with the Civil Rights movement but no one can deny the impact of the US Supreme Court’s decision decriminalizing homosexual sexual acts in Lawrence v Texas which overruled Bowers v Hardwick. The US Supreme Court in 2003 reversed the Court’s ruling just 16 years earlier on due process grounds. Citing the 14th Amendment’s Due Process Clause, the Court said in its 6-3 ruling that states cannot punish homosexual couples for engaging in sex acts that are legal for heterosexuals.

Homosexual couples currently can marry in Massachusetts, Connecticut and Iowa and will be allowed to marry in Vermont starting in September 2009 and in New Hampshire from January 2010. Other states offer same-sex unions that grant many of the same rights as marriage.

Forty-two U.S. states explicitly prohibit gay marriage, including 29 with constitutional amendments, according to Human Rights Campaign, a gay rights advocacy group. Michigan is one of them. However, public opinion in Michigan is slowly swaying towards the acceptance of gay marriage.

Speaker Pro Tempore and Michigan House of Representative District 52 Pam Byrnes is set to announce at the 2009 Michigan Pride rally at the Capitol the launch of an effort to amend the Michigan Constitution to allow gay marriage. The proposed amendment would repeal the marriage amendment approved by voters in 2004 which reserved marriage exclusively for unions of one man and one woman, and replace it with specific authorization for gay and lesbian marriage rights.  Byrnes was motivated to launch this new initiative after seeing the results of a recent poll which was first reported June 7 in the Detroit Free Press which indicated Michigan voters have become more favorable to the idea of same sex unions since the marriage amendment was approved in  2004, states Pam Byrnes, D-Chelsea. 

The poll referenced by Byrnes showed considerable support for gay-friendly policies, but less than a majority (46.5%) in favor of gay marriage. The ballot proposal endorsing traditional marriage was approved 58%-42%, demonstrating more than 4% more support for gay-friendly initiatives today than in 2004.
