The present Public representatives vis-a-vis immunity provided to them in the Constitution

The Parliament Members are  provided certain powers,privileges and immunities vide Article 105 of the constitution.Some of these protections as mentioned below-

No member of Parliament is liable to any proceedings in any court in respect of anything said or any vote given by him in parliament or any committee there of.
No person is liable in respect of the publication by or under the orders of either House of Parliament of any report,paper,votes and proceedings.
No court shall look into the validity of its proceedings.
No Member of Parliament is answerable to any court for exercise of the powers vested in him under the Constitution.
Complete freedom of speech without restrictions applicable as in Article 19(1)(a).

These previleges are given to the Members of the Parliament of either house who are elected  directly or indirectly  based on  adult frachise.In the system voters in India are deemed to be citizens of the country who are not less than18 years of age and not disqualified under the Constitution or any law made by the appropriate legislature or certain grounds like non-residence,unsoundness of mind,crime,illegal or corrupt practices,have right to be registered as voters in any election.Now a days voters in India ,by and large, are divided on the basis of  caste ,creed or society which make them unsound and partial in electing their candidates.Some of them are influenced by a rate(price) to vote an allure by candidates in the fray which is certainly a crime and a corrupt activity.Hence these voters should be deemed to be as disqualified for voting and the members elected by these voters have no stature which should be that  of the Members of Parliament who are elected without money,caste or muscle power. Hene these members of the Parliament have no right to claim dignity,protection ,protection and immunities which are embodied in the constitution.Like wise the Prime Minister who is the leader of the majority group /party  and the other ministerial collegues who are picked up from the group have no right to  protection which is entitled in the Constitution.

Considering the present scenario of elections to the Members of the parliament the hue and cry raised by certain political  parties and government members of the Lokpal Bill drafting commity regarding the threat to parliamentary democracy and the Consitution of India by civil society members is not warrented.In fact the Members of the Prliament and ministers including Prime Minister are servants of the people and ought to work for the people and are to be  guarded and corrected by a strong, impartial,rigid mechanism which should be seperated from executive like judiciairy.So the process of drafting a strong and stringent bill is the need of the day to tackle the monster of corrution which extended its clutches to the burocracy,,judiciary and politics.

Norman R. Allen, Jr., founder and executive director of African Americans for Humanism, has traveled extensively across Africa and the U.S., and bears a disturbing message. He has been asking, “What effects are religion, especially literalistic and conservative religious tenets, having on blacks around the world? Are the clear anti-science, anti-medicine, anti-thinking trends in both Africa and across the African-American communities the result of religion? Does religion promote the spread of AIDS? Does Humanism stand out in combating these movements into ignorance and superstition?”

In Tampa, on April 18, Norm Allen will report his findings about organized humanism and skepticism on the African continent, and the challenges that pro-science activists there face. He discovered numerous religious and superstitious obstacles to the teaching of good science. Allen analyzed what African humanists and skeptics are doing to defend and promote a reason-based worldview.

Norm Allen also explored some of the challenges in advancing science and secularism within the African American community. “There is a strong pressure to conform to the religious ideal among various black skeptics and atheists, including many historical African American figures.” He doubts that religion remains a liberating force for African Americans. “Allen says, “Many anti-science trends are growing in the Black community, including those coming from Black entertainment outlets promoting anti-science such as psychic 900 lines, televangelists and belief in prophecy.” He ties all of this together in an exploration of religion and secularism as they relate to political activism, including the influence of high-profile Black preachers, such as Reverend Jeremiah Wright, President Barack Obama’s spiritual advisor.

Norman R. Allen, Jr. is the executive director of African Americans for Humanism, an educational organization primarily concerned with fostering critical thinking, ethical conduct, church-state separation, and skepticism toward untested claims to knowledge among African Americans.

Kick the Liberals Out and Reset the Constitution

With members of the ultra-left Middlebury Institute sitting down with members of the League of the South, who are devoted to more limited government, and the two discussing plans for leaving the United States, the topic of secession has once again become just slightly more popular dinner conversation than how much lint Aunt Carla found in her belly button last night. Both groups, despite their divergence on almost everything else political, want to be able to leave the United States peacefully.

The liberals, of course want to leave because they are tired of living in a nation that actually defends itself, its allies and its interests around the globe and is constantly pushing back against their nanny state plans for everyone. The League of the South wants to leave because it is tired of the over burdening regulation that has piled up in Washington over the years because of these same liberals they are now rubbing elbows with. They both see secession as the only way to solve this problem. They both want to leave but I say that if you truly believe in limited government, and our Constitution, you don’t want to secede.

What you need to do is simply agree to kick the liberals out or, in the case of the leftists in Vermont, let them walk away.

If people like those that are members of the Second Vermont Republic want to try yet another failed experiment in Marxism I say let them. And while they are at it they can take New York, California, Michiganistan, The Kennedy Empire (formerly known as Massachusetts), Washington, New Jersey and Oregon with them. Heck, we’ll even throw in Hawaii so they can actually have some place in liberal la-la land that people will actually want to visit for a couple days each year. Until they manage to run it into the ground and turn it into the next Cuba that is.

But there is no reason to want to leave the United States yourself IF you truly believe in the founding principles of the American Republic. You know, radical things such as all men created equal, unalienable rights, limited government and all that good stuff which are spelled out clearly in our founding documents.

Southern secessionists have many different stripes. Some are your old school Democrats still looking to re-fight the Civil War, upset they lost, wanting to get out the sheets and form lynch mobs to go after uppity blacks while some are radical isolationists and yet lots of others are people simply and truly fed up a federal government run amok. But to suggest that you need to leave the union could be possibly the dumbest thing in the world especially when, as I already stated, many liberals seem eager to leave themselves.

Why secede and start from scratch when you can just kick the liberals out?

Folks like the League of the South argue that the Constitution is beyond repair after years of tinkering by leftists. But really it’s not. Think about how easy it would be to correct all the problems heaped upon us by nebby, leftist do-gooders who have a distorted view of history, innate humane abilities, basic English and economics if we simply said to them, to quote Douglas Adams, “So long and thanks for all the fish”.

When you look at where the vast amount of socialism is being proposed comes from with regards to members of our Congress, kicking out states that are the major troublemakers and demonstrate that they no longer believe in our Constitution by their continual election of anti-American Marxists would almost immediately halt and then reverse our country’s leftward march.

But the issue of secession and the permanence of the union was settled when General Lee surrendered at Appomattox wasn’t it? Hardly.

It is often falsely believed that the Civil War settled the issue of a state’s right to simply leave Republic and that the answer to the question of secession was a resounding no. But this is not the case. As I often gleefully point out, the Civil War was fought over many issues but one that caused the biggest divide between Northern and Southern states was the issue of slavery.

Yes, I know that many of you who have been educated in the government schools have been taught that this is not the case. But like so much that has been revised about history in our education system, the truth is much different from what you might have been taught. Several southern states made it painfully clear that it was, in fact, the issue of slavery and the anti-slavery movement in America that prompted them to secede. States like Mississippi, Texas, Georgia and South Carolina all cited the north’s their anti-slavery stance ad nauseam in well preserved declarations of why they wanted out of the union. Sure, it wasn’t the only issue but when you see the word “slavery” appear over and over and over and over again in these declarations only a fool would not take notice and admit that there just might have been something or other having to do with slavery that caused the war.

No, the issues of the Civil War, while many, was not about ending once and for all a state’s “right” to leave the union. It was however, partially, about the right of the federal government to act in order to defend those which were being held in bondage and who had committed no crime other than the falsely perceived offense of being inferior based on the color of their skin. In short it was about a State’s right to secede in order to continue to deprive men and women of their unalienable rights.

And before you start trying to cite how things like segregation and racism exploded in the south after the war, I would like to remind you of something else that you might never have been taught in you government approved history classes. That lesson is that until the North and the Republican Party gave up on the philosophy of Reconstruction because they had grown weary and too weak of will to complete what they had started, blacks had thriving communities that were only threatened when the Democrats were allowed to take back the south bringing us poll taxes, Jim Crow laws, and so on that set this nation on a course of racial strife for the next century.

So the Civil War worked and served its purpose. At least until people gave up on seeing it through to the end for political expedience and just generally succumbing to the typical short attention spans Americans often exhibit in matters of importance.

But since slavery based on the color of one’s skin is no longer an issue in wanna-be Marxist utopias like Vermont and no citizen is being held against their will (at least until the liberals build their walls to keep them from fleeing their “compassion”) and could freely leave the state should they want to leave, or as I have proposed be kicked out of, the Union, there would be no reason to stop them.

I agree with the League of the South that states have the right to leave the union. It’s right in Amendment X to the Constitution where it says all powers NOT given to the federal government are reserved by the states and the people. Since forced retention of member states is NOT a power found in the Constitution anywhere, obviously the states have the power to leave.

I agree with the League of the South that the federal government has become too unwieldy due to the more the liberal states including my own Pennsylvania. But we part company after that. Because I still believe that the Constitution complete with its amendments is, stripped of all the superfluous and liberty destroying regulation piled on top of it over two-hundred some odd years, about as perfect a document for the formation of government ever created. And there is no reason to even try to reinvent the wheel.

Of course letting the deepest of blue states secede because they think they can do things better does pose certain problems. After they establish their “utopia”, or “utopias” if they can’t agree amongst themselves exactly how to do such, the same thing that always happens with Marxist states will inevitably happen again. The economies will falter to a point where not even the lobster boats out of Massachusetts will be able to operate and catch enough to feed their populace while the vineyards of California go unplanted and deprive the elite of their wine because taxes and regulation make it more bother than it is worth to grow grapes. Waves of poor and starving citizens will start to look to cross the border illegally into the remaining United States looking for a better life. And we’ll be discussing whether or not we should build walls to keep them out and prevent them from bringing their liberalism back with them to re-infect us.

And after years of watching their citizens flee, in these utopias where the rich who were taxed at obscene rates to feed the rest until there are no more “rich” the rumblings of Emperor Kennedy and his ally Comrade Clinton will begin as they rattle their sabers. They will claim that the those evil folks from the United States stole their stuff and that they are victims of the evil capitalists. Walls topped with barbed wire will sprout up complete with machine gun nests manned day and night to watch for any ungrateful souls not pleased with their masters and seeking a way out. And their citizens will be more worried about finding bark on trees to eat for dinner and postulating their escape to pay much attention to the bloviating of their leaders.

But at least they’ll have “free” healthcare, their retirement taken care of and food stamps to purchase bread from the empty shelves of the local market.

Honestly, the sooner they leave, or are kicked out, the better! That’s what I say!

The Charity, Freedom, and Diversity Party — Who are You Trying to Fool?

What they are clamoring for is to lower the age of consensual sex from 16 to 12 immediately and eventually eliminate an age limit altogether. They are also asking the Dutch parliament to make it legal for television stations to broadcast hard core pornography during the day. Furthermore, they want to legalize public nudity and bestiality. In addition, they believe that everyone should get to ride the trains for free. Oh yes, and they oppose cruelty to animals.

According to a recent poll, 82% of the citizens of the Netherlands believe that their government should do something to stop the new party, while 67% agree that promoting pedophilia should be illegal. This suggests that most Hollanders are as shocked and outraged as the rest of us.

Grotesque misnomer
I see no need to become indignant and vitriolic about what is obviously a publicity stunt by an insignificant special-interest group. But when I heard about this incident, I was troubled by their choice of a name. Does pedophilia sound to you like charity and freedom? Is it really diversity?

Definitive examination
The original meaning of “charity” (from the Latin, caritas) was love or affection. The King James Version’s rendering of 1 Corinthians 13:13 comes to mind: “Now abideth faith, hope, and charity, but the greatest of these is charity.” More recently, the word has come to mean, according to Webster, “the provision of help or relief to the poor; something that is given to help the needy.”

Freedom is defined as “the condition of being free of restraints; liberty of the person from slavery, oppression, or incarceration.” Diversity’s definition is “the fact or quality of being diverse; difference; a point or respect in which things differ.”

Self-imposed victimization
By choosing these terms to denote their cause, the pedophiliacs seem to be focusing our attention on them as recipients of our charity, beneficiaries of freedom we allow them, and the objects of our tolerance of their divergence from our norms. Their name is a plea, as if they are crying, “Accept us for who we are and what we do, in the name of charity, freedom, diversity.”

Most political parties seek to focus on what they propose to do to benefit humanity (whether they ever do is another issue). Even the Communist Party uses its name to point to a principle they see as positive, the enforced sharing of capital and labor. But this party does not offer anything positive beyond their “chicken-in-every-pot” promise of free train tickets and happy, healthy animals.

Nothing on sex with minors?
The Bible has nothing specifically to say about pedophilia. It does address it indirectly when it limits the sexual relationship to marriage. Paul says, “Because of sexual immoralities (the Greek words here, tas porneias are plural), let each man have his own wife and each woman her own husband.” (1 Corinthians 7:2, see verses 1-5). Jesus quotes Genesis 2:24: “A man will leave his father and mother and be joined to his wife, and the two will become one flesh” (Mark 4:7-8; Matthew 19:5). These passages do not say, “…and be joined to a child….”

The state’s interest
In both the Netherlands, the United States, and other countries, governments have a clear interest in the welfare of children. Laws against pedophilia are designed to protect children from sexual deviants, and the prohibitions serve as a barrier (though not an insurmountable one) that urges pedophiliacs to restrain themselves from harming the children they prey upon. These laws at the very least communicate to the pedophiliac, we think you have a problem. If you will not restrain yourself, we will restrain you, both for your own sake, for this behavior is psychologically destructive, and for the present and future of our children.

Plausible lying
We live in a culture in which we are bombarded with hundreds of commercial messages every day. As Dorothy Sayers described the advertising industry in her 1933 mystery novel, Murder Must Advertise, advertising consists of constantly telling plausible lies. Should we be surprised that unpopular, even repugnant causes label themselves with titles that mislead us, quell our indignation, and justify what is wrong?

I can only ask, are the children involved receiving charity? Do they have freedom, freedom to be innocent, freedom from manipulation and abuse? Isn’t there a point when diversity morphs into perversity? Or is perversity itself about to be redefined out of existence?

All too common technique
The same kind of plausible lying takes place in other movements attempting societal re-engineering, including those promoting homosexual lifestyles, seeking the abolition of monogamy, defending abortion on demand, doctor-assisted suicide, euthanasia, etc. Plausible lying also frequently takes place in the halls of our governments. They go to war, impose tariffs, destroy ecosystems, defend torture and wrongful imprisonment, prop up shady businesses, and so on, trying to hide a multitude of sins beneath a blizzard of plausible lies. And yes, it occurs in churches as well, justifying bloated budgets, explaining away hasty pastoral departures, defending fizzled programs.

When we examine what a group stands for and stands against, we have to allow for the possibility that this kind of marketing is taking place. Rather that gulping down everything dished out to us, we should nibble tentatively, unsure how much we can believe. Knowing how often this happens, we should be quick to ask, “Who do you think you are fooling?”

True charity, freedom, diversity
Christians, at least, have a polestar by which they can assess everything: Jesus Christ and the inspired Word of God. But we also can be deceived by lies that sound plausible.

What God wants of us is deeper thinking and greater caring. Our heart must ache for the children involved with pedophiliacs. It must also ache for the perpetrators themselves. But compassion cannot condone pedophilia in the name of tolerance. It can’t condone something destructive to everyone involved; that would not be charity.

Christian compassion must run deep enough to envision freedom–a true freedom that escapes old habits and patterns of thinking, that seeks new approaches to control entrenched urges. Compassion, true compassion, must be deep enough and strong enough to say, diversity, as praiseworthy as it usually is when applied to ethnicity, race, class, needs limits for it to retain its value. Otherwise, ‘diversity,’ like ‘charity,’ and ‘freedom,’ becomes just one more plausible lie.

On June 15 the Berkeley City Council became the latest and largest city to pass a resolution regarding corporate constitutional protections. The council unanimously supported amendments to the California state and U.S. Constitutions declaring that corporations are not granted the protections or rights of natural persons and that expenditure of corporate money is not constitutionally protected free speech. The resolution asserts that corporations dominate the political process and deny citizens their right to govern through democracy. Ted Nace, founder of Berkeley’s Peachpit Press, a leading computer book publisher, said, “This resolution is not anti-business. The Berkeley City Council vote comes while the documentary film, “The Corporation,” a study of corporations, their origins and their place in the modern world, is playing at a local Berkeley cinema as well as nearly 300 theatres all over the country.
