Q&A: Does freedom of religion grant me the right to smoke cannabis?

Question by Christy: Does freedom of religion grant me the right to smoke cannabis?
Well, because of freedom of religion, Native Americans are legally able to use drugs like mushrooms and mescaline, because it is part of their religion. In the Christian’s Bible, Jesus says “and I give you all of Earth’s plants to use” or something along those lines, so does that give me the right to use cannabis? Thoughts?

    No, that just gives you a right to be an idiot. Freedom of religion does NOT mean freedom to use illegal or harmful substances.

  • The Bible also permits the slave trade, but that doesn’t mean you should be able to own human beings. There are limits to what freedom of religion involves.

    Actually, if you can identify the religion, then perhaps. BTW, you will need more than a general belief that god gave you all the plants. You will need a dogma that not only permits, but commands you to use all the plants, and to use them in the specific fashion of burning them and inhaling the smoke.
    If you get past that, then the problem will involve possession when not actually engaged in religious rites, Also, unless your god also commanded you to conspire with a drug seller, or to grow all the plants, that is going to be another problem. If you try to persuade the jury that your religion commands you to use all the plants, then you had better be using them ALL and be able to identify all the plants, not just the ones that will get you high.
