Knowledge Of Local Constitution About Criminal Liability In Self Defense Is Advisable

The Constitutions and laws of various countries across the world allow their citizens to use their right of self-defense for seeking protection against any predator to avoid any harm, injury or mishap. The residents may take legal measures to keep out intruders. The Many states of the world also permit their citizens to keep arms for their self-defense. We can see in the US Constitution that allows bearing arms for personal safety and security. Similarly several other countries also encourage keeping arms for the sake of your self-defense.

However, a question arises at this point that if a person defends himself and the assailant is of the view that he is hurt, the will the defender be liable? There may be two completely different scenarios for liability: one of them is criminal liability and the second is civil liability.

 

When it comes to avoid criminal liability then it is better to take a look at your Constitution about this term. As according to law of New Jersey you can employ force against your predator if you logically think that showing such type of reaction is essential on urgent basis to keep yourself safe and protected against the intentional unlawful act of your attacker. When you apply such justifiable force against the assailant then it is generally refers to “self-defense.”

Therefore we can conclude that it is highly important for you to know about the laws of your jurisdiction so that whenever you find yourself in trouble then you can freely exercise your right of self-defense without fear of any legal proceedings that many of the people have to face afterwards.

2009 Health Care Reform Bill, Pros & Cons – What About the Constitution?

There is daily coverage of the 2009 Health Care Reform Bill pros and cons. The coverage is incessant and well it should be. This health care plan will change our lives. However, there is a fundamental question that is ignored, what about the Constitution?

Very recently, Speaker of the House Pelosi was asked by CNS News, “… where does the Constitution grant Congress the authority to enact an individual health insurance mandate?” Her response was, “Are you serious? Are you serious?” CNS News: “Yes, yes I am.”

Later, Pelosi’s press secretary went on record as saying, “That is not a serious question.” My question: “Asking for Constitutional clarification is not a serious question?”

I have another question just how many of our Senators and Representatives do you think have actually read the Health Reform Act? Yes, I think you are right. Not very many.

Regardless, it seems to me that it is not within Congress’ or President Obama’s authority to dictate to any citizen whether an individual must carry health insurance. How about you? How do you feel about it?

It is like automobile seat belt laws. I know that there is evidence to support the use of seat belts. Still, in my naive way of thinking, I cannot accept being fined for not wearing my seatbelt. There is no evidence that my not wearing a seatbelt will hurt any one else.

So then, this law, the seatbelt law, is a law for my own good. A law passed by those that know better for my own good. Whatever happened to my unalienable rights? I realize that those unalienable rights are not part of the Constitution but they are words on which this nation was founded (The Declaration of Independence).

Some would argue that enacting a Public Health Policy requiring health insurance under penalty of prosecution falls under the Congress’ Constitutional prerogative or right and duty “to promote the general welfare”. I agree.Promoting the general welfare is Congress’ obligation. However, it is not their prerogative, duty or right to dictate the general welfare. Promoting and dictating are two distinct words with completely different meanings.

Any law that would require a citizen to insure himself for his own protection under penalty of prosecution is not promoting. That is dictating. It is enforcement, not a suggestion.

Do not confuse the likes of auto liability insurance, which is an enforced law in most of the country, with a required health insurance mandate.

Liability insurance protects you from the consequences of someone else’s actions. If someone causes harm or damage to you or your property, you have recourse. Liability insurance protects you from someone else’s negligence not your own.

Requiring liability insurance is promoting the general welfare. That mandate protects you from others. Health insurance protects you for you. It does not protect you from someone else.

Requiring me or anyone else to have medical insurance under penalty of prosecution is just plain wrong.

Maybe we should also require mandatory life insurance, so that I can pay those exorbitant funeral costs. What do you think?

Brutal answers here. The hijab doesn’t cover the face, mouth, etc. It only covers the hair.

No matter where you live, whether it is in San Diego, Orange County, Los Angeles, La Jolla, Del Mar, Pacific Beach, Carlsbad, Oceanside, San Marcos, Mission Beach and Escondido or the cities of Huntington Beach, Anaheim Hills, Yorba Linda, Buena Park, Anaheim, Santa Ana, Irvine, Costa Mesa, Irvine, Newport Beach, Corona del Mar, Laguna Beach, and Laguna Hills, Buena Park, Temecula, Indian Wells, La Quinta, or Palm Springs, unless you haven’t turned on the television or read a newspaper during the 2008 Presidential election, or looked at the internet, you have seen claims by the Republican campaign that the publishing media is biased.

Attacking the media has long been a tactic of national candidates. In this election, once again, we have seen this tactic employed, yet with little of the success it enjoyed in previous Presidential campaigns.  As an election and  constituitonal lawyer, one can only applaud this lack of success in the use of this tactic in this election.

For the most part in this Presidential campaign, one candidate has been leveling these attacks on the press with regularity and with increasing anger, John McCain. While newspapers expect this to some extent, the public that is not wedded to one side of the fence or the other appears to be tiring of the attacks.

Recently, John McCain denounced the New York times in the strongest words, following a Times report that McCain’s campaign manager, Rick Davis, had been pain nearly million by mortgage entities Fannie Mae and Freddie Mac. McCain’s chief strategist, Steve Schmidt said the New York Times is no longer a journalistic organization but is 150 percent in the tank for Barack Obama. Schmidt earlier attacked MSNBC as being an organ of the Democratic National Committee, and said the news media are on a mission to destroy Sarah Palin.

Unfortunately for John McCain, it has since been reported in the press that McCain’s campaign manager’s lobbying firm owned by his campaign manager has received ,000/month for nearly three years and that and that the campaign manager was paid ,000/month for nearly five years by an advocacy organization that he headed and which was financed by Fannie Mae and Freddie Mac to fight regulation. It has further been reported that McCain’s senior advisor, his campaign’s vice chairman, and his Congressional liaison, also made large sums of money from Fannie and Freddie lobbying or were in firms that did.

In an apparent attempt to deflect attention away from his mistaken attack on the New York Times story, McCain then announced he was suspending his campaign to immediately fly to Washington after awaking that morning to find a report in the Washington Post that he was behind in the polls by nine points. Soon after attempting to criticize that finding, and knowing what the disaster Sarah Palin’s interview with Katie Couric would be aired that night, McCain chose to dump his appearance on the David Letterman show, upstage the Couric interview with his own interview on the CBS News, and announce the suspension of his campaign that was in reality, never a suspension.

In hindsight of course, McCain’s actions were a huge error in judgment. His dilly-dallying around New York after ditching Letterman were picked up on and hammered at him unmercifully for two nights on the David Letterman show and later on the Daily Show, other news shows, on the internet and in the press. By the time he arrived the next day in Washington, it had already been announced that there was bipartisan support for the bailout bill, that just as quickly dissipated upon his arrival. It was reported that his campaign had not been suspended and Letterman, among others joked at his expense why he must have felt he could not leave his campaign in the hands of Sarah Palin, when she was seen incapable of answering simple questions put to her by Katie Couric. And after announcing he would not take part in the debate until there was either a bailout bill or great progress toward one, he had to fly back from Washington for the debate with no bailout bill in hand and Congress much less united than when he had arrived.

In the past, attacking the press has proved fruitful for Presidential candidates. This time the attack is falling on deaf ears and has either been the exception to the rule that it will help a candidate, or there is a change taking place in what a candidate risks if he is wrong.  As an election, campaign, publishing, marketing, media and constitutional law attorney, one can only conclude that negative attacks by the candidates are not working as they used to, whether it is against the media or against the other candidate.  The public has become weary of such tactics and it is showing in the polls.

The swell of patriotism that rolled across America after the attacks of 9-11 caused many lawmakers to take another look at American students’ declining report card in American history and civics. America’s students have scored poorly on civics tests and many know little about the basic freedoms on which America was founded.

As a result of this disturbing trend, state lawmakers in Florida and Arkansas followed Texas’ lead and in 2002 and 2003, initiated special curriculum programs in K-12 grades called Celebrate Freedom Week. According to the statutes, one week during each school year students will receive special instruction on America’s founding freedoms and founding documents like the Declaration of Independence.

“Declare IT!” (http://www.declareitprogram.com) is a new, privately sponsored program that supports Celebrate Freedom Week in Florida, Arkansas and Texas, offers additional program awareness and provides free teaching resources to teachers and parents.

Founded by Jack Boyd of Alpharetta, GA, the program offers a free, fun sing-along song and teaching resources with online links to lesson plans for Celebrate Freedom Week. Boyd founded the program after his two children did a high school history project on Celebrate Freedom Week in Florida. Boyd discovered that Floridians’ knowledge of the program was low and teacher participation was inconsistent.

“America’s students need a solid understanding of America’s history to become the leaders America needs in the future. Celebrate Freedom Week is a great step toward that goal. However, the program is not getting the focus it needs in many areas and teachers need our help. It’s appropriate on this 5-yr anniversary of 9-11, when we pause to remember the lives lost in that tragic event, that America’s teachers, leaders and parents recommit ourselves to teaching our children about the freedoms that were also attacked that day,” said Mr. Boyd.

In 1998, Jack Boyd and daughter Steffy wrote ‘The Declaration of Independence Song,’ a sing-along song to help Steffy learn the words to the Declaration for a 4th grade homework project. Offered on a CD to teachers and parents in 2002 through their website (http://www.declarationsong.com), the song has become very popular with teachers, home school parents and others across the country. The “Declare IT!” website offers a free download of a shortened version of Boyd’s popular sing-along plus an online video documentary on the history of Florida’s Celebrate Freedom Week.
