Unfortunately for Delaware Senate candidate Christine O’Donnell, that education — which came at Delaware’s Widener Law on Thursday — was courtesy of her opponent in the race, Democrat Chris Coons, in the midst of their second debate. After scolding Coons for his lack of knowledge of constitutional law for stating that intelligent design should not be taught in public schools (a matter decided in a scathing decision in the case of Kitzmiller v. Dover School District), O’Donnell challenged her rival on his assertion that the US Constitution creates a distinct separation between church and state. “Where in the Constitution is separation of church and state?” O’Donnell asked. Upon hearing her words, the audience in the room burst into laughter. Video of the debate captures the moment at the 2:46 mark. Later in the proceedings, after fielding questions on the candidates’ views on repealing the 14th, 16th and 17th Amendments, Coons returned the conversation to the question of the constitutionally mandated separation of church and state. “I absolutely oppose the widespread proposals by tea party candidates for us to repeal the 14th, 16th or 17th amendments.” Coons said. “I also think you just heard, in the answers from my opponent, and in her attempt at saying ‘where is the separation

  • @kbgoro You’ll never convince most Americans, who believe in a creator, that the founding fathers, who believed in a creator, a theory (intelligent design), based on a creator, should not be taught to their children alongside a theory based on atheism (evolution) in public schools paid for by taxpayers. Just because some Supreme Court judges interpret the 1st amendment that way does not make it truth.

  • @patriot473 A legal document drafted by our founders to the British king, states that the colonists’ uninalienable rights are endowed by a CREATOR. If some of the colonists were atheists then it violated their (not yet written) 1st Amendment right. This is why the seperation of church & state interpretation is flawed.

  • Just because a nation does not establish a national meal like say pasta or tacos, you can’t assume a separation of food and state.   • A Separation of Church and State”

    So where would you find the phrase, “A wall of separation between church and state,” in any official government document?

    Try the Soviet Constitution of 1977:

    Part I Principles of Social Structure and Policy, Chapter 7, Article 52 [Religion],

    “(2) In the USSR, the church is separated from the state, and the school from the church.”

    This phrase has been in all the Soviet Constitutions since 1918.

    In 1947, our Supreme Court found that phrase, not in a legal, controlling, or founding document, but in a letter written by Thomas Jefferson in 1802, 13 years after the Constitution was ratified by the states. The letter was written to the Danbury Baptist ministers to relieve their anxiety over a potential national denomination.

    Jefferson used that phrase in the context of the 1st Amendment preventing a national denomination. Remember, the 1st Amendment is a prohibition against Federal Government intrusion into religion. It says, “Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; …” In this context Jefferson was correct as the 1st Amendment creates “A wall of separation between Church and State” in order to prevent a national denomination.

    Why did the Supreme Court use Jefferson’s words out of context in 1947? Jefferson had nothing to do with the writing of the Constitution and Bill of Rights because he was the Ambassador France when these founding documents were written. It is because this was as close as the judges could come to supporting their own agenda since there were no precedents for this decision and no foundations for it in our Constitution.

    Jefferson’s actions speak volumes in this area. As president and acting D.C. School Board Chairman he chose the Holy Bible and Watts Hymnal to be used in the D.C. public schools. He also attended church at the U.S. Capitol building for the majority of his eight-year tenure as President. He had no understanding of the concept of “Separation of Church and State” as the courts are applying it today.
