Virginia Highland County Prior Conviction Reckless Driving Constitutional Right Lawyers Attorney

CLEM KINCAID v. COMMONWEALTH OF VIRGINIA

December 1, 1958

The defendant, Kincaid was convicted in the circuit court on April 23, 1957, of reckless driving. Later he was again, charged with reckless driving. He was tried and convicted of this latter charge on November 6, 1957, and the judgment entered on that conviction is the subject of this appeal. During the course of the trial the Commonwealth introduced evidence of the previous conviction (April 23, 1957), which evidence was admitted over the objection of the accused wherein he asserted that the evidence was inadmissible as the warrant on which he was being tried did not charge a second offense. In instructing the jury, over the objection of the accused, the court set forth the penalties for a second offense of reckless driving, and the jury imposed a fine as permitted under the instruction and as provided in the statute (Code, § 46-210 as amended; now § 46.1-192, 1958 Cum. Supp.) for a second offense. The accused moved to set aside the verdict as contrary to the law and without evidence to support it, and further urged the court to grant him a new trial on the ground that the court erred in permitting the introduction of evidence relating to the previous conviction. These motions were overruled and judgment was entered on the jury’s verdict. The defendant sought review of the decision.

Issues:

Whether the trial court erred in admitting evidence relating to the previous conviciction?
Whether a defendant in a criminal case can be taxed with the costs of a jury without invading his constitutional right to trial by jury?”

Discussion:

This court held that it was error for the court to admit the evidence relating to the prior conviction and to instruct the jury regarding the punishment for a second offense. In this case the warrant simply charged that the accused did unlawfully operate a motor vehicle on the public road in a reckless manner and did not charge him for a second offense. Thus he should have been put on trial for the offense as charged and no other this court held that under the evidence, the issues involving the identity of the accused and whether or not he was guilty of reckless driving were for the determination of the jury

This court held there is no merit in the contention that the taxing of the costs of the jury is an invasion of the constitutional right of the accused to a trial by juryCode, § 19-296 imposes upon the clerk of the court the duty to make up a “statement of all the expenses incident to the prosecution” and issue an execution therefore. The costs of a jury are an expense incident to the prosecution, and its collection violates no constitutional right of the accused.

Conclusion:

The court reversed the judgment of the trial court, which convicted the defendant of reckless driving and overruled his motions to set aside the verdict and for a new trial. The court remanded the case for a new trial.

OPSEC- A History Of The Security Underdog

Operations Security, most often known by its acronym OPSEC, is a valuable methodology that protects critical (or, in certain circles, Classified or private) information by tracking and protecting the publicly available (or, sometimes, Unclassified) information.

As a mindset, OPSEC has been practiced for thousands of years. When Sun Tzu wrote in ‘The Art of War’ (6th Century BC China), “Secret operations are essential in war; upon them the army relies to make its every move”, he was describing an early understanding of OPSEC. When George Washington said, “Even minutiae (small matters) should have a place in our collection, for things of a seemingly trifling nature, when enjoined with others of a more serious cast, may lead to a valuable conclusion”, he, too, was demonstrating a solid understanding of what we now call “OPSEC”.

As a formalized process, OPSEC originated in the Vietnam War, when the “Purple Dragon” team was formed in order to determine how enemy forces were obtaining advanced information regarding US military operations. At this, they were very successful, and OPSEC soon propagated informally into other military functions within Vietnam, and eventually the United States mainland.

On January 22, 1988, the nature of OPSEC in the United States changed forever. On that date, then-president Ronald Reagan, due to the diligent work of key members of the original Purple Dragon team, signed National Security Decision Directive Number 298 (more commonly referred to as NSDD 298), which for the first time formalized OPSEC as a National program. In addition, NSDD 298 directed the creation of a National OPSEC entity, which was to be called (and is to this day) the Interagency OPSEC Support Staff, or the IOSS. The IOSS was tasked with, and has succeeded in, becoming the Nation’s foremost experts in OPSEC, and charged with preserving and developing the official standards, policies and methodologies of Operations Security.

Today, largely thanks to the work of the IOSS, OPSEC has taken a sort of life of its own, and grown into something that’s recognized across the Nation, and across multiple disciplines and categories. It’s come from being a strictly military methodology into one that’s used with equal effectiveness within the government, corporate, civilian and even personal sectors. Other groups have also grown to support the mission of the IOSS, and to help develop the OPSEC discipline, and to help equip professionals in the field. One such group is the Operations Security Professional’s Association (OSPA). OSPA specializes in the development of OPSEC training material, online OPSEC training and other tools and resources.

One can never measure, or even possibly know, how many lives have been saved due to OPSEC, but the soldier in combat depends on it every day. One can never know how many corporate dollars and livelihoods have been saved by applying OPSEC to the business sector, but the employee depends on it for their job. OPSEC has uses in an incredibly wide assortment of fields and situations, including law enforcement, domestic violence outreach, facilities security and more. In reality, one is unable to find any situation or enterprise that could not be benefited by it. OPSEC can be inexpensive or costly, fun or deadly serious- but it is always an effective tool in your security arsenal.

A basic understanding of computer networks is necessary for understanding the elements and principles of the Internet security. There are tools that can be used to reduce the number of networking attacks. In the modern world of risk to the security computers, a corporation needs to use a multilayered approach in order to protect the information located on the computer from network attacks. The difference of the national security from a corporate cyber security is in its large scale of security issues, problems that have to be solved. Weaknesses in broadly used software and hardware products can create problems at the national level, thus, requiring coordinated activities for the development of improved technologies. Besides, the lack of trained professionals is the issue of a national level concern. The national cyber security focuses on preventing and protecting against cyber attacks at a national level. It is aimed at securing information infrastructures of the USA.

A firewall is a powerful technology used for host protection at a corporation. It can reduce the risk exposure introduced by internetworking hosts, defend the network against attacks. It simply blocks access to ports, IP addresses, protocols and services to prevent the network threats. Many corporations use one of three possible types of firewalls.

1. Application gateways are the first firewalls and are known as proxy gateways. They are created from hosts which use particular software for acting as a proxy server. The application gateways are considered to be the most secure as they do not permit anything to pass by default. Before using it and the Internet one must be proxitized. However, they have a drawback – they are slow in the process.

2. Packet filtering is a tool with the help of which routers have access control lists turned on. There is little overhead in packet filtering as the access control tool is fulfilled at a lower ISO/OSI layer. Besides, a packet filtering gateway is usually faster than application gateways. Still, there are disadvantages of using it as TCP/IP has no possibilities to guarantee the correctness of the source address.

3. Application gateway and packet filtering are useful tools in a cyber security issue. However, there exist hybrid systems, which unite the security of the application layer gateways with the flexibility and speed of packet filtering. Hybrid systems are highly recommended for corporations.
