What power is granted to the president in the constitution which allows the president to act outside the constitution, and, therefore allows for the president to check or balance of the executive branch?

Please give an example. All of us – including the president – who’ve taken the oath to “…protect and defend the Constitution ….” aren’t given a list of exceptions. The Constitution is not very specific in a lot of areas so the president has some wiggle room but he can’t “check and balance himself. By definition the checks and balances come from the other branches of government.

Certainly her salary as President, which is P60,000 a month or P720,000 a year, cannot justify such an increase. One should also eliminate from the equation possible gains from stock market trading because unless she or her stockbroker are trading geniuses, making the kind of killing she would have to make to justify her net worth increases would be very improbable because of the stock market decline in 2008. Thus, she would have to show very large increases in her other income which would be most naturally attributed to the income of her spouse. This, she still has not done. Actually the Philippines has very strict laws that if implemented properly, would show unexplained wealth and possible graft and corrupt practices by government officials right away. Our 1987 Constitution mandates it. Oklahoma Wesleyan University (OKWU) today announced a $ 2 million commitment from Chesapeake Energy Corporation to construct The Keating Institute. The institute will honor the former Governor and his wife for their exemplary service to the state of Oklahoma and will be devoted to the study of free enterprise, constitutional liberty, the rule of law, federalism and Judeo-Christian values. The Keating Institute will house the Oklahoma Wesleyan School of Business, which will be renamed The Chesapeake Energy School of Business. The constitution was a fulfillment of the the Revolution, in the fact that the whole war was fought simply for the right to make such a document!

Boston Rare Maps, one of the country’s premier specialist dealers in rare and unusual antique maps, presents AmericanMapmaking.com, a virtual online exhibition of antique American maps from the late 18th Century. Originally hosted at the Harvard Map Collection, “Toward a National Cartography: American Mapmaking, 1782-1800” traces the evolution of mapmaking during the formative years after the American Revolution, revealing the ways in which Americans sought to transform the landscape to suit their newly established economic and political goals. Included in the exhibition are works by renowned mapmakers such as Osgood Carleton, Andrew Ellicott, John Fitch and many others. Exhibition curator Michael Buehler of Boston Rare Maps originally assembled this lineup of rare and unusual maps for display at the Harvard Map Collection, and now offers the digital collection to viewers around the world. Buehler is a long-time collector of rare maps and historical ephemera, is a regular public speaker on the subject and has published numerous articles on “The Portolan”, the journal of the Washington Map Society. Highlighting this unique exhibition is a 1792 plan for “The city of Washington in the Territory of Columbia”, now Washington D.C., by surveyor Andrew Ellicott. The plan depicts a grand capital on the European model, with broad avenues, large public squares and dramatic sightlines. Its unstated intent was to convey the grandeur and permanence of the national government – which at the time was only three years old, boasted a bureaucracy of fewer than 200 employees and rested on a Constitution that was feared as much as it was venerated.

The exhibition also tracks urban development in the Northeast with Osgood Carleton’s “Accurate Plan of the Town of Boston”, published in May of 1797. Carleton’s plan of Boston was the largest and most accurate map of the town published to date. It was based primarily on a survey he conducted “by order of the General Court,” as part of a state mapping project begun in 1794. This was one of the last significant maps of Boston before the great land-making projects of the 19th century, which created the Back Bay. Noteworthy landmarks include the new State House on Beacon Hill (on land that once belonged to John Hancock), as well as the Charles River and West Boston Bridges.

American expansion is also chronicled and can be seen in John Fitch’s “Map of the North West Parts of the United States of America,” published in 1785. Fitch, a mapmaker and surveyor who went on to invent the steamboat, compiled this map primarily from William McMurray’s map of the United States, along with information from his own surveys. Fitch engraved the map himself and printed it on a press of his own construction. Like McMurray’s map, which is also included in the exhibition, Fitch depicted the Old Northwest carved into ten proto-states as specified by the Land Ordinance of 1784.

Additional featured works include maps of New England, Massachusetts, New York, Baltimore, North Carolina and beyond by prominent mapmakers like Dennis Griffith, Jonathan Price, Phinehas Merrill, Matthew Clark, John Norman and many others. In addition to city plans and maps, the exhibition also includes antique postal and road maps, navigational charts, and numerous additional cartographical specimens from post-Revolution America.

A Bronx landlord of a Riverdale building is being sued by the Justice Department for race discrimination, a civil rights violation in New York.

Manhattan U.S. Attorney Preet Bharara filed the civil rights violation lawsuit (Case # 11-06713) against the landlord, management company and superintendent for allegedly discriminating against African-Americans seeking apartments. The lawsuit claims they offered apartments to whites but not to African-Americans.

The race discrimination lawsuit was filed in Manhattan federal court.

According to the civil rights violation complaint, Loventhal Silver Riverdale LLC, Goodman Management Co. and superintendent Jesus Velasco had “engaged in conduct constituting illegal discrimination” since at least April of 2009.

“There are a number of reasons a landlord can legitimately reject a tenant, including a bad credit report or an unstable employment history. However, landlords can’t treat tenants or potential tenants differently because of a personal characteristic or feature like race or disability,” said New York civil rights violation lawyer David Perecman, founder of The Perecman Firm, one of New York’s civil rights violation law firms.

As New York civil rights violation lawyers understand, the federal Fair Housing Act makes it illegal for a landlord to refuse an apartment or house rental application based on race, color, religion, national origin, sex, disability and familial status.

According to the New York Daily News, Loventhal, Goodman and Velasco were caught after African-American and white “testers” visited the building, posing as would-be renters.

As reported by the New York Daily News, Velasco refused to give a black tester a rental application on April 8, 2009, but a short while later provided a white tester with an application, according to the New York race discrimination lawsuit.

On May 8 and Nov. 18, 2009, Velasco steered away African-American testers while offering apartments to white testers at discounts, as reported by the New York Daily News.

“This civil rights violation lawsuit should strongly remind other landlords that they will be held accountable if they engage in or enable others to engage in discrimination against prospective tenants in New York,” civil rights violation lawyer Perecman said.

Prerogative theory is that elected politicians do that the constitution grants them and more and can go against what the constitution says if needed to better represent the people that elected them. This interpretation is lenient when it comes to the constitution.
